Fuel Waivers
EPA, working with the Department of Energy, responds quickly to address fuel supply disruptions caused by, for example, refinery or pipeline infrastructure damage as the result of a hurricane or other natural disaster, by issuing emergency waivers of certain fuel standards in affected areas. When issued, these temporary waivers are necessary to help ensure that an adequate supply of fuel is available, particularly for emergency vehicle needs. There were no waivers issued in 2009, 2010, 2013 and 2015.

On August 28, 2024, the EPA issued an emergency waiver which responds to a fuel supply emergency caused by a power outage and resulting emergency shutdown of the ExxonMobil Joliet refinery when tornadoes touched down in and around the Chicago, Illinois area on July 15, 2024. Arizona
On April 25, 2024, the EPA issued an emergency waiver of gasoline volatility requirements in certain parts of Arizona. The emergency waiver responds to a fuel supply emergency caused by an unplanned service disruption and resulting delay on the western pipeline that supplies Arizona with cleaner burning gasoline. On September 21, 2023, the EPA issued an emergency waiver of gasoline volatility requirements in certain parts of Arizona. The emergency waiver responds to a fuel supply emergency caused by an unplanned service disruption and resulting delay on the western pipeline that supplies Cleaner Burning Gasoline from California refineries. On August 30, 2023, the EPA issued an emergency waiver of federal gasoline volatility requirements in Florida. The emergency waiver responds to a fuel supply emergency caused by Hurricane Idalia. Texas
On August 28, 2023, the EPA issued an emergency waiver of gasoline volatility requirements in El Paso County. The emergency waiver responds to a fuel supply emergency caused by unplanned outages at the Alon Big Spring and the Marathon Petroleum Corporation El Paso Refineries that supply low volatility gasoline to El Paso County. On April 20, 2023, EPA issued an emergency waiver of the federal gasoline volatility requirements in parts of Florida. The emergency waiver responds to a fuel supply emergency caused by a major weather event and flooding that disrupted fuel terminal operations in Broward County, Florida. On May 28, 2022, EPA issued an emergency waiver of the 7.8 Reid Vapor Pressure fuel requirements in certain counties in the State of Texas. The emergency waiver responds to a fuel supply emergency caused by a crude unit failure at the Delek refinery in Tyler, Texas. The waiver begins May 28, 2022, and ends June 6, 2022. 2021 Fuel Waivers
Port Fourchon, Louisiana
On September 7, 2021, EPA issued a waiver of the ultra-low sulfur diesel fuel requirements at Port Fourchon to help improve the fuel supply circumstances caused by Hurricane Ida. The fuel waiver will allow the sale at Port Fourchon of higher-sulfur diesel fuel (normally designated for ocean-going vessels) for use in any marine vessel and any nonroad engines and nonroad equipment used offshore. On September 2, 2021, EPA issued a second waiver of the Reid Vapor Pressure (RVP) requirements in Louisiana and Mississippi as part of the EPA’s response to Hurricane Ida. On May 11, 2021, EPA issued an emergency waiver of the low volatility Reformulated Gasoline (RFG) requirements in RFG Covered Areas in District of Columbia, Maryland, Pennsylvania, and Virginia. Texas
On March 5, EPA issued a waiver of the Texas Low Emission Diesel (TxLED) requirements that apply in certain counties of Texas, through March 25, 2021. This was part of the EPA’s response to continued diesel supply issues in certain counties of Texas from the unusually severe temperatures and frozen precipitation. On February 19, EPA issued a waiver of the Texas Low Emission Diesel (TxLED) and El Paso oxygenate requirements that apply in certain counties of Texas, through March 5, 2021. On September 12, EPA issued an emergency waiver of the Reid Vapor Pressure (RVP) requirements for conventional gasoline in Georgia and the Commonwealth of Virginia, and the low volatility Reformulated Gasoline (RFG) requirements in the following localities and counties within the Commonwealth of Virginia: Charles City County, Chesapeake, Chesterfield County, Colonial Heights, Hampton, Hanover County, Henrico County, Hopewell, James City county, Newport News, Norfolk, Poquoson, Portsmouth, Richmond, Suffolk, Virginia Beach, Williamsburg, and York County. On September 7, EPA issued a waiver of the federal requirements for low volatility “summertime” gasoline requirements in all east coast states located in PADD 1, all midwestern states located in PADD 2, an all Gulf coast states located in PADD 3. - A: EPA's August 29, 2017 waiver allows dyed diesel fuel with a sulfur level of 15 ppm or lower to be sold, distributed, and used in highway vehicles throughout the entire State of Texas until September 15, 2017. However, EPA reiterates that the waiver expressly limits the sulfur content to 15 ppm for the dyed diesel fuel allowed under this waiver. The use of diesel fuel exceeding 15 ppm sulfur could create engine operational problems in addition to harming vehicle emission controls resulting in adverse effects on human health and the environment, and therefore is not allowed under this waiver.
On August 26, 2017, EPA issued an emergency fuels waiver to expand the scope of the August 25 waiver, to cover all reformulated gasoline (RFG), low Reid Vapor Pressure (RVP) and Texas Low Emission Diesel (TxLED) requirements that apply throughout eastern Texas, through September 15, 2017. - Q: Are parties who produce, import or distribute gasoline under the EPA's October 31, 2012, multi-state waiver required to add ethanol to gasoline blends?
- A: No. In the states covered by the multi-state waiver, parties can produce, import and distribute gasoline from CBOB, RBOB, RFG and conventional gasoline without blending oxygenates, including ethanol. (If supplies are available, EPA recommends blending ethanol, but it is not required under the waiver.) Parties who produce, import and distribute gasoline for sale in the areas covered by the waiver must ensure that the gasoline that they sell and distribute meets all other applicable standards.

Nationwide fuel waiver issued to bolster fuel supplies
On Aug. 31, EPA waived the requirement to sell "summer gasoline" which contains a lower volatility limit. This action has the effect of allowing early use of wintertime gasoline. EPA is also allowing the use of diesel fuel that exceeds 500 ppm sulfur content. Both waivers were effective through Sept. 15 and were applicable throughout all 50 states, U.S. territories and the District of Columbia.
