Public Comment Period for Proposed RCRA Hazardous Waste Management Permit
Introduction
Pursuant to the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act of 1976 (RCRA), and as further amended by the Hazardous and Solid Waste Amendments (HSWA) of 1984, the U.S. Environmental Protection Agency (EPA) proposes to issue a RCRA Permit for hazardous waste operations at the Safety-Kleen Systems Inc., Davenport Branch (facility), located at 3035 W. 73rd Street, Davenport, IA 52806.
Background
Safety-Kleen Systems Inc. is the owner and operator of a commercial hazardous waste storage facility.
This facility serves as a collection point for hazardous wastes generated by their customers. All hazardous wastes are ultimately transported to a Safety-Kleen recycling facility or other properly permitted facility. This facility is on approximately 2.4 acres, which is zoned commercial, and located in Scott County.
Safety-Kleen began operation in 1983 and is currently operating under a RCRA permit that was originally issued by EPA to the facility on March 31, 1992. The permit was reissued by EPA on Sept. 29, 2011.
The facility consists of a building with offices; a warehouse that includes a hazardous waste container storage unit; and tank farms that include one aboveground hazardous waste storage tank. The container management unit and tank unit both have adequate secondary containment.
On March 24, 2021, EPA received Safety-Kleen’s application to renew its RCRA hazardous waste permit. After a thorough technical review of the permit application, including subsequent revisions to the application, EPA prepared a proposed permit for this facility.
EPA’s proposed permit will allow the facility to continue to accept hazardous waste from off-site customers and to operate the existing hazardous waste storage facility. The facility also will be allowed to continue to store hazardous waste in a container storage unit and an aboveground tank unit. The permit has conditions that require the facility to properly operate, inspect and maintain the storage units. The facility property use must remain industrial due to on-site soil contamination, and child care facilities must be prohibited. The facility is also required by this permit to respond to or clean up any future releases of hazardous wastes or hazardous constituents that may occur at the site.

The 45-day public comment period begins Aug. 13, 2021, and ends Sept. 27, 2021. Comments must be submitted before the end of the public comment period.

A public hearing has not been scheduled. However, requests for a public hearing can be submitted in writing to Patricia Murrow at the address listed above. Requests must state the nature of issue(s) to be raised at the hearing and must be submitted before the end of the public comment period. If a written request for a public hearing with a statement of issue(s) to be raised is received, EPA will conduct a public hearing to receive both oral and written comments.

The Administrative Record (AR), which contains the proposed permit and supporting documents used by EPA in preparing the proposed permit, is available for review during the public comment period at the locations below during normal business hours. After consideration of all comments received during the public comment period, EPA will make the final permit decision. Notice will be given to the permit applicants; all persons who submitted written comments; those who commented at any public hearing (if applicable); and those who requested notice of the final permit decision.
If none of the comments received during the public comment period result in revision(s) to the proposed permit, it will become effective immediately upon its issuance. If comments received during the public comment period result in revision(s) to the proposed permit, it will become effective 30 days after service of notice of the final decision or at a later date, if a review is requested under Title 40 of the Code of Federal Regulations, Subpart 124.19.
