Public Comment Period for Proposed RCRA Permit
Introduction
Pursuant to the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act of 1976 (RCRA), and as further amended by the Hazardous and Solid Waste Amendments (HSWA) of 1984, the U.S. Environmental Protection Agency (EPA) proposes to issue a RCRA Part II Permit for operations at the Green America Recycling facility, located at 10107 Highway 79, Hannibal, MO 63401.
Background
Green America Recycling is a commercial hazardous waste storage and treatment facility. However, the regulated activities are performed by both Continental Cement Company LLC and Green America Recycling LLC, and both are the permittees for the proposed RCRA Part II Permit.
Continental Cement is the owner of the facility and operates a dry process industrial furnace, which consists of a pre-heater/pre-calciner and rotary cement kiln with an air pollution control system that has a membrane filter baghouse for the raw mill and a membrane filter baghouse for the alkali bypass system. Clinker is produced, which is the main ingredient in Portland cement.
Continental Cement uses pulverized coal and/or petroleum coke as fuel in both the rotary cement kiln and pre-calciner burner system. To supplement its fuel needs, Continental Cement also uses a variety of liquid and solid hazardous waste-derived fuels, and non-hazardous waste fuels.
The burning of hazardous waste for energy recovery in the cement kiln is regulated under RCRA and the Hazardous Waste Combustor Maximum Achievable Control Technology requirements of the air pollution regulations Title 40 Code of Federal Regulations (CFR) Part 63, Subpart EEE. A Part 70 Operating Permit was issued to Continental Cement by the Air Pollution Control Program of the Missouri Department of Natural Resources (MoDNR) on June 6, 2014.
Green America Recycling operates the hazardous waste fuel program, which includes receiving, sampling, off-loading, storing, and processing the liquid and solid hazardous wastes received at the facility.
Green America Recycling is currently operating under a Missouri-issued Hazardous Waste Management Facility Part I Permit and an EPA-issued RCRA Part II Permit. The Part I and Part II permits were originally issued by MoDNR and EPA in October 1999. These permits allow Green America Recycling to store and treat hazardous wastes and to burn liquid and solid hazardous wastes, as supplemental fuel, in the pre-calciner burner system within the rotary cement kiln system.
On Oct. 13, 2009, Green America Recycling submitted a permit application to EPA and MoDNR to renew its hazardous waste permits. After a thorough technical review of the permit application, including subsequent revisions to the application, EPA prepared a proposed Part II Permit for the Green America Recycling facility. In addition to hazardous waste codes authorized by MoDNR, EPA’s Part II Permit covers three listed hazardous waste codes – F032, F034 and F035 – and allows for the treatment of hazardous wastes in the pre-calciner burner system within the rotary cement kiln system. MoDNR reissued to Green America Recycling the Missouri Hazardous Waste Management Facility Part I Permit, effective Nov. 18, 2019.
Public Comment Period
EPA encourages the public to review the proposed Part II Permit. Any interested persons may submit written comments on this proposed permit. All comments should be submitted in writing to:

The 45-day public comment period begins July 6, 2021, and ends Aug. 20, 2021. Comments must be submitted before the end of the public comment period.

A public hearing has not been scheduled. However, requests for a public hearing should be made in writing to Patricia Murrow at the address listed above. Requests must state the nature of issue(s) to be raised at the hearing and must be submitted before the end of the public comment period. If a written request for a public hearing with a statement of issue(s) to be raised is received, EPA will conduct a public hearing to receive both oral and written comments.

After consideration of all comments received, EPA will make the final permit decision. Notice will be given to the permit applicants, all persons who submitted written comments, those who commented at any public hearing (if applicable), and those who requested notice of the final permit decision.
If none of the comments received during the public comment period result in revision(s) to the proposed Part II Permit, the permit will become effective immediately upon its issuance. If comments received during the public comment period result in revision(s), the Part II Permit will become effective 30 days after service of notice of the final decision or at a later date, if a review is requested under Title 40 CFR, Subpart 124.19.
