Public Comment Period for Proposed Remedy
Introduction
The U.S. Environmental Protection Agency (EPA) Region 7, in consultation with the Missouri Department of Natural Resources (MoDNR), invites the public to comment on the Proposed Remedy for the Industrial Services Corporation/QAS Resource Conservation and Recovery Act (RCRA) facility (MOD073027609), located at 1633/1635 Marsh Avenue in Blue Summit, Missouri. The public comment period begins Dec. 14, 2021, and ends Jan. 17, 2022.

Comments received will be summarized in a Response to Comments, which will be mailed to those individuals providing the comments. The Response to Comments will be drafted at the conclusion of the public comment period and incorporated into the Administrative Record. EPA may modify the remedy selected, based on new information and comments from the public.
Background
This notice is being provided as required by an Administrative Order on Consent for Corrective Action, Docket No. VII-94-H-0024 dated Sept. 30, 1994; and developed pursuant to RCRA, 42 U.S.C. section 6901 et seq. The facility is a former interim status RCRA hazardous waste treatment, storage, and disposal (TSD) facility that collected and processed waste oils from 1958 through 1996. Closure activities were conducted in 1998 wherein all tanks and associated equipment were removed from the facility.
The following interim measures have been taken since closure:
- Removal of impacted soil at the tank farm.
- Filing of a deed notice.
- Installation of a cap, groundwater interceptor trench, and monitoring well network.
- Operation of a groundwater extraction and treatment system.
- Installation and removal of three rounds of oxygen release compound (ORC) treatments into extraction wells.
- Decommissioning of extraction wells.
- Regular groundwater monitoring.
Contamination at the Facility
Some residual soil contamination remains in place in soil; however, it is covered by the cap. The primary contaminants remaining at the facility are arsenic, manganese, 1,4-dioxane, and vinyl chloride in groundwater.
Proposed Remedy
The Proposed Remedy prevents unacceptable exposure to contaminated groundwater and soil, and consists of the following:
- Develop and record a legal instrument to: 1) prohibit residential use of the facility and other impacted property, 2) prohibit disturbing the cap, 3) restrict the installation of water supply wells and use of groundwater at the facility and other impacted property, and 4) require precaution and proper materials management when digging.
- Finalize post closure documents that will dictate the required actions that MoDNR will oversee.
- Maintain and inspect the cap.
- Develop and conduct a groundwater monitoring program to evaluate groundwater concentrations of facility contaminants.
- Maintain a cost estimate and financial assurance to conduct the work.
- Decommission monitoring wells not associated with the monitoring program and not required in the future, as determined by MoDNR.

A public hearing or public availability session has not been scheduled, but will be held if there is sufficient public interest. EPA will evaluate any requests and hold a hearing or session if it finds that one will contribute to the decision-making process by clarifying significant issues affecting the Proposed Remedy.
EPA will make a final remedy decision only after the public comment period ends and all comments are reviewed. EPA may change the Proposed Remedy based on any new information and comments from the public.
