Summary

EPA proposes to enter into a Complaint, Consent Agreement and Final Order with Tucumcari Feedyard, Inc. under Section 309(g) of the Clean Water Act (CWA), 33 U.S.C. § 1319(g), based on alleged violations of CWA Section 301(a), 33 U.S.C. § 1311(a). EPA alleges that Respondent failed to submit required annual reports for 2023 and 2024 by March 31, 2024, and March 31, 2025, as required by its permit. The proposed settlement assesses a civil penalty of $3,750.

Consistent with CWA Section 309(g)(4)(A), 33 U.S.C. § 1319(g)(4)(A), and EPA’s Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties, 40 C.F.R. Part 22, EPA is providing public notice of this proposed settlement and will consider all comments received before taking final action.
