Public Notice: Trivium Packaging, Sparks, Nevada: Proposed Settlement of Clean Water Act Class I Administrative Penalty
Summary
EPA is providing notice of a proposed administrative penalty settlement with Trivium Packaging (Respondent) for violations of the Clean Water Act (CWA) at its facility located in the Tahoe-Reno Industrial Center in Storey County, Nevada. EPA alleges the Respondent violated the effluent discharge and reporting standards for the Coil Coating Can Making Subcategory, as required by 40 CFR § 465.45.
In accordance with Section 309(g) of the Clean Water Act (CWA), 33 U.S.C. § 1319(g), and the Consolidated Rules of Practice at 40 C.F.R. Part 22, EPA and Respondent have entered into a Proposed Expedited Settlement Agreement (ESA) to simultaneously commence and conclude this CWA Class I civil administrative penalty proceeding. Under the Proposed ESA, Respondent will pay the United States a civil administrative penalty of $5,970 to resolve this matter.

Description of Business or Activity Conducted by the Respondent: Respondent manufactures metal packaging, i.e. metal cans. The facility receives uncoated flat steel sheets and pre-coated tin-plated steel sheets to make two types of can styles in various shapes.
Summary of Alleged Violations: Respondent is a categorical industrial user (CIU) under the CWA pretreatment regulations, specifically 40 CFR § 465.45 Subpart D – Coil Coating Can Making Subcategory. As required by 40 CFR § 403.6(b), a CIU must have equipment installed to treat process wastewater before discharging to the public sewer system. For the past five years, Respondent violated the effluent discharge limit for chromium seven times. As required by 40 CFR § 403.12(e), a CIU must submit periodic reports to demonstrate continued compliance. For the past five years, Respondent failed to submit complete reports five times. The effluent discharge limit violations and reporting violations constitute 12 violations of the CWA.
