Final Action

EPA Region 9 (EPA) issued a minor New Source Review (NSR) permit for the Jamul Casino Resort (Source) to the Jamul Indian Village Development Corporation located at 14191 Highway 94, Jamul, CA 91935 on March 20, 2026. The Source is located at 14145 Campo Road, Jamul, California 91935, within the Jamul Indian Village Reservation. The contact for the Source is Mary Cheeks, (619) 315-2250.

The Jamul Casino Resort, previously named Hollywood Casino, began construction in 2014 and opened in 2016. The facility recently expanded to include an adjoining 16-floor hotel and resort, including dining, bar, spa, roof top pool deck, fitness center and banquet facilities, which opened in August 2025.

Original equipment at the casino includes two (2) 2,180 kilowatts (kW) engine-generator sets (gen-sets), four (4) boilers, and three (3) water heaters. The new hotel has two (2) additional gen-sets (an 829-kW unit used at the hotel and a 568-kW unit used at the wastewater treatment plant), and three (3) additional boilers used at the hotel. All gen-sets are used for emergency backup power only. The Source has the potential to emit nitrogen oxides, volatile organic compounds, carbon monoxide and particulate matter. The Source qualifies as a true minor source for permitting purposes, which means the Source’s potential to emit without restrictions is more than the minor source threshold but less the major source threshold. The permit, however, contains a restriction of 52 hours per year per gen-set for non-emergency use.

The public comment period started on February 5, 2026, and ended on March 6, 2026. No public comments were received.

Permit Appeal

In accordance with 40 CFR 49.159(d)(1) and 40 CFR 124.19, within 30 days after a final permit decision has been issued, any person who filed comments on the draft permit or participated in a public hearing may petition the Environmental Appeals Board (EAB) to review any condition of the permit decision. Any person who failed to file comments or to participate in the public hearing may petition for administrative review of any permit conditions in the final permit decision, but only to the extent that those final permit conditions reflect changes from the proposed draft permit. The 30-day period within which a person may request review under this section begins with service of notice of the final permit decision. A petition to the EAB is a prerequisite to seeking judicial review of the final agency action under Section 307(b) of the CAA. For purposes of judicial review, final agency action occurs when we deny or issue a final permit and agency review procedures are exhausted. Following an appeal to the EAB, the EPA will issue a final permit decision as specified in 40 CFR 124.19(l).

Permit Effective Date: This permit became effective on March 20, 2026.
