EPA values your input on the battery removal process. All members of the public are invited to participate in a public comment period by submitting written comments on the Administrative Record. These types of comments will be most beneficial for informing EPA’s oversight of the response:

  • comments on EPA’s decision to take response action at the site, such as comments endorsing or opposing the decision to conduct a response at the site;
  • comments describing how the response activities may impact you (positively or negatively); and
  • comments regarding the scope of the response proposed in the agreement.

Summary

The U.S. Environmental Protection Agency Region 9 (EPA) has compiled the Administrative Record (AR) for a Time-Critical Removal Action in Moss Landing, California, which is available for public comment over the next 30 days.

EPA is overseeing the removal of damaged batteries from the site under an agreement with Vistra Corp.

The agreement was entered pursuant to EPA’s authority to address imminent and substantial endangerment to human health and the environment under federal law.

The AR is a compilation of documents that supports EPA’s decision to take an action at the site. In general, an AR contains the documents forming the basis for EPA’s determination that conditions at the site—in this case, damaged lithium-ion batteries—necessitate a response action.
