A final permitting decision has been made to issue a Clean Air Act (CAA) Permit for the Texas Gulflink, LLC. (TGL) Deepwater Port (DWP). TGL proposes to construct and operate a DWP in federal waters approximately 26.6 nautical miles southeast of Freeport, Brazoria County, Texas. The CAA permit is a combined synthetic minor new source review (NSR) preconstruction and title V operating permit, Permit Number R6NSRT5-DWP-GA9. In accordance with the CAA, as amended (42 U.S.C. §§ 7401 et seq.), the U.S. Environmental Protection Agency (EPA) has reviewed permit applications submitted by TGL in order to develop the initial permit for the offshore DWP.
EPA issued public notice soliciting comments on the draft permit on May 21, 2025, providing for a comment period beginning on May 22, 2025, and closing on June 24, 2025. In the initial public notice, EPA also provided notice of a virtual public hearing to be held on June 24, 2025, contingent upon timely submission of requests for the hearing to be held. EPA received timely requests for a hearing and updated the public notice on June 10, 2025, providing instructions on how interested parties could register to participate in the scheduled virtual public hearing. EPA subsequently held the public hearing on the draft permit on June 24, 2025, as originally scheduled. During the hearing EPA announced that the public comment period would be extended until June 27, 2025, and would update public notice documents and websites accordingly the very next day. The public comment period lasted a total of 37 days. EPA received a total of 1130 public comments during the public comment period, including 63 comments delivered orally during the public hearing.
The final CAA permit signed on September 11, 2025, a copy of the permit decision transmittal letter, EPA's Basis of Decision and Response to Comments documents, other supporting documents for this permit action and all public comments received in the docket during the comment period have been added to the Administrative Record available online at the Regulations.gov website in the docket for the TGL DWP specific to EPA’s CAA permit action for this facility:
