Summary

The U.S. Environmental Protection Agency (EPA), Region 5, is providing notice of intent to execute a Consent Agreement and Final Order (CAFO) with Tricor Industrial (“Respondent”) for alleged violations of the Clean Water Act (CWA). EPA alleges that Respondent failed to comply with its National Pollutant Discharge Elimination System (NPDES) Permit (“Permit”) by failing to meet effluent limits for total suspended solids, document its responses to benchmark exceedances, update the Stormwater Pollution Prevention Plan (SWPPP), maintain annual reports with the SWPPP, document stormwater inspections, and provide a complete discharge description, in violation of the Permit and Section 301 of the CWA, 33 U.S.C. § 1311. 

The EPA and Respondent have agreed that Respondent will pay a civil penalty of $102,121. Full payment of the penalty will resolve Respondent’s liability for federal civil penalties for the violations alleged in the CAFO.
