Summary

EPA is providing notice of a proposed administrative penalty settlement with the City of Plummer for violations of the Clean Water Act at its wastewater treatment facility located in Plummer, Idaho.

EPA alleges that the respondent failed to comply with its National Pollutant Discharge Elimination System permit at its wastewater treatment facility. The permit covers discharges of pollutants into Plummer Creek.

Alleged violations include 1,466 effluent exceedance violations, failure to submit required monitoring reports, failure to properly develop and/or update its operation and maintenance plan and quality assurance plan, and failure to conduct surface water monitoring.

This action is being simultaneously commenced and concluded in a legal document called a consent agreement. Under the proposed agreement (see "related documents"), the City of Plummer will pay a civil penalty of $7,000.

This is a Class II administrative penalty proceeding governed by Section 309(g) of the Clean Water Act (33 U.S.C. § 1319(g)), and the procedural rules found at 40 CFR Part 22. The requirements that apply to public comment and participation are set forth in Clean Water Act Section 309(g)(4) and 40 CFR § 22.45.
