Summary

The EPA is providing notice of a proposed administrative penalty settlement with Woodgrain Millwork, Inc., for violations of the Clean Water Act at its facility located in Nampa, Idaho.

EPA alleges that the respondent failed to comply with EPA’s 2015 and 2021 Industrial Stormwater General Permit/Multi-Sector General Permit at its Woodgrain Millwork facility. The permits cover discharges of pollutants into Indian Creek.

Alleged violations:

  • Failure to sample and monitor outfalls.
  • Failure to install and maintain stormwater control measures and best management practices.
  • Failure to submit timely discharge monitoring reports.
  • Failure to collect representative samples from its main outfall.
  • Failure to maintain records.
  • Failure to facilitate additional implementation measures.
  • Failure to maintain a Stormwater Pollution Prevention Plan according to the written standard.

This action is being simultaneously commenced and concluded in a legal document called a Consent Agreement and Final Order. Under the proposed agreement, Woodgrain Millwork, Inc. will pay a civil penalty of $125,000.

This is a Class II administrative penalty proceeding governed by Clean Water Act Section 309(g) (33 U.S.C. § 1319(g)), and the procedural rules found at 40 CFR Part 22.
