Purpose

GAP provides Tribes and intertribal consortia:

  1. Financial assistance to build Tribal government capacity to implement programs under statutes administered by EPA.
  2. Financial assistance for Tribal governments to meaningfully participate in federal environmental programs administered by EPA or authorized states, territories, other Tribes, or local governments.
  3. Financial assistance for the Tribal solid and hazardous waste program development and implementation in accordance with the purposes and requirements of applicable provisions of law, including the Solid Waste Disposal Act (commonly known as the Resource Conservation and Recovery Act, or RCRA) and the 2018 Consolidated Appropriations Act.
  4. Technical assistance from EPA to Tribes and intertribal consortia in the development of multimedia programs to address environmental issues.

Eligible Applicants Federally Recognized Tribes and Intertribal Consortium
Eligible Activities Planning, developing, and establishing capacity to implement environmental protection programs administered by EPA and implementation of solid and hazardous waste programs. Specific activities may include defining and developing administrative and legal infrastructures; conducting assessments, monitoring, planning and other actions; fostering compliance with federal environmental statutes by developing appropriate Tribal environmental programs, ordinances and services; and establishing the capacity to meaningfully participate in authorized environmental program implementation activities of federal, state, local and other Tribal governments.
Excluded Activities/Other Restrictions

Funds cannot be used to fund activities not closely related to and consistent with the programs administered by EPA. Excluded activities generally include:

  • Salaries and expenses of a Tribe’s chief executive, Tribal council or judiciary branch.
  • General costs of government services normally provided to the general public such as fire and police.
  • Goods or services for personal use.
  • Construction activities unrelated to solid waste implementation activities, including wastewater treatment facility construction, drinking water system construction, construction related to nonpoint source pollution control, and purchase of construction equipment. Other construction activities may be eligible with approval of the National Program Office.
  • Environmental protection program implementation as defined in the 2022 GAP Guidance, other than solid and hazardous waste programs.
  • Operation and maintenance of Tribal drinking water and wastewater facilities.
Pre-Funding Requirements (if applicable)

Applicant must meet eligibility requirements in Title 40 of the Code of Federal Regulations in section 35.502, including, for an intertribal consortium, adequate documentation that all GAP-eligible member Tribes authorize the consortium to apply for and receive the award.
