Summary

The U.S. Environmental Protection Agency (EPA) intends to issue an Underground Injection Control (UIC) permit under the authority of the Safe Drinking Water Act and UIC Program regulations. This permit would authorize Carbon Storage Solutions, LLC (CSS) to inject fresh water from pump trucks into the Lyons Formation. CSS has applied to convert a Class II stratigraphic test well, named Front Range 1-1, which was permitted by the Energy and Carbon Management Commission, into a Class V well. This conversion is intended for conducting formation testing, including step-rate tests, pressure fall-off tests, and formation injectivity tests with fresh water, to determine the fracture pressure of the Lyons Formation. Once this testing is completed and approved by the Director, the well will be temporarily abandoned until it is converted to another UIC well class or a non-UIC well.

CSS has concurrently submitted a Class VI carbon sequestration permit application to the EPA. The data results from the tests will be used to provide a more robust permit application, such as updated geologic modeling, for the proposed Class VI well. The well construction complies with EPA regulations to protect USDWs, however further analysis is required for the Class VI permit. The well is 9,000 feet deep, and underground sources of drinking water (USDWs) are protected by an upper confining zone that consists of 608 feet of confining shales.

The proposed approval is for a Class V permit using freshwater treated with biocides and corrosion inhibitors with a permit duration limited to two years. EPA’s proposed approval for this Class V permit does not convey any determination regarding CSS’s pending Class VI permit application.
