Public Notice: Proposed Penalty of $24,127 against Hill MHP, LLC

Summary

The U.S. Environmental Protection Agency (EPA), Region 3, is hereby giving notice that it proposes to enter into a Consent Agreement and Final Order (“CAFO”), which commences and concludes an administrative action against Hill Mobile MHP, LLC for the Hill Mobile Home Park Sewage Treatment Plant, located at the intersection of Lakewood Road and A.P. Boulevard, Bowling Green, Virginia, 22427 (“Facility”). 

The CAFO assesses an administrative penalty of twenty-four thousand one hundred twenty-seven dollars ($24,127.00) under 309(g) of the Clean Water Act, 33 U.S.C. § 1319(g), for alleged violations of Section 301 of the Clean Water Act, 33 U.S.C. § 1311.  EPA alleges that Hill MHP, LLC violated certain provisions of CWA Sections 301 for unpermitted discharges from the Facility. The $24,127.00 civil penalty is in accordance with the EPA’s Interim Clean Water Act Settlement Policy dated March 1, 1995, which reflects the statutory factors set forth in Section 309(g) of the Clean Water Act.
