Summary

Announcement of Final Permit Decision to Issue Federal Synthetic Minor New Source Review Permit

The U.S. Environmental Protection Agency Region 6 (EPA) is announcing its decision to issue a Synthetic Minor New Source Review permit in accordance with the provisions of the Clean Air Act (CAA) and the Federal Minor New Source Review Program in Indian Country, 40 CFR § 49.151 - § 49.161, to Pueblo of Sandia, for the Sandia Resort and Casino. The existing facility is located on the Pueblo of Sandia sovereign lands in Albuquerque, Bernalillo County, New Mexico.


The EPA prepared a draft permit and held a public comment period from May 4th through June 3rd, 2022. The EPA also offered the public an opportunity to request a public hearing. No public comments nor requests for a public hearing were received during the comment period.


EPA also informed nine (9) Pueblo Governments within a 50-mile radius of the Facility’s proposed permit action. This notification was sent thirty (30) days prior to the public comment period. The notification letters dated April 4, included an invitation to the nine (9) Pueblo Governments for government-to-government Tribal consultation, if the Pueblo Government so chose. It was outlined in the letters that this invitation continued through the thirty (30) day public comment period. EPA received no request for government-to-government Tribal consultation during this sixty (60) day period. The ending of the public comment period closes out the Tribal consultation period for this permit action as well.


The final permit is effective immediately upon issuance pursuant to 40 CFR § 49.159(a). The final permit, basis of decision, the technical support document (TSD) and other key documents relevant to this permit action can be found under Docket No. EPA-R06-OAR-2022-0316 at www.regulations.gov .
