Public Notice: Reopening For Cause Title V Federal Operating Permit, Public Comment and Public Hearing for Harvest Four Corners, LLC (Harvest) Los Mestenios Compressor Station

Summary of Agency Action:
The United States Environmental Protection Agency (EPA) provides notice of and requests public comments on the reopened for cause Clean Air Act (CAA) Part 71, title V federal operating permit proposed for the Harvest Los Mestenios Compressor Station (Facility). EPA has reopened for cause certain portions of the Facility’s existing operating permit. As described in 40 CFR 71.11(a)(5), draft operating permits shall be publicly noticed and made available for public comment. However, reopening for cause requirements found at 40 CFR 71.7(f)(2) further states that “proceedings to reopen and issue a permit shall follow the same procedures as apply to initial permit issuance and shall affect only those parts of the permit for which cause to reopen exists”. The public notice of permit actions and public comment period is described in 40 CFR 71.11(d). If finalized, the proposed title V permit would regulate air pollutant emissions associated with operation of the facility.
Background:
Harvest Four Corners, LLC – Los Mestenios Compressor Station (Facility) is an existing facility in Rio Arriba County, New Mexico that has operated since the late 1960’s. The location of the existing Facility is in a remote location of the northwestern quadrant of New Mexico, approximately 24 miles northwest of Gavilan, New Mexico and is located on the Jicarilla Apache Nation (JAN) Reservation. The Facility is a natural gas compressor station that accepts produced natural gas gathered from various wellheads in the gas fields surrounding the Facility and compresses this gas for delivery to natural gas processing plants.
The Los Mestenios Compressor Station is at: Latitude 36.45083 and Longitude -107.31722.
Proposed Reopening for Cause title V Federal Operating Permit:
According to 40 CFR 71.7(f)(1)(iii), issued operating permits shall be reopened for cause if the permitting authority determines that the permit contains a material mistake or that inaccurate statements were made in establishing the emissions standards or other terms or conditions of the permit.
EPA is narrowly reopening for cause the Part 71 permit to correct and remove the inclusion of certain permit terms. The revisions that are subject to this reopening are:
- To correct the Title V permit to exclude certain emissions limitations and associated monitoring, recordkeeping, and reporting (MRR) requirements.
- EPA will revise “Table 1: Part 71 Permit History” in Section 1 by removing existing references to the 1996 Permit as forming the basis for renewal.
- Table 2 in Section 1 to note that only the Solar Saturn Turbine and emergency generator are regulated emissions units.
- Section 2 and Table 4 to note that only emissions of NOX, VOC, and CO from the Solar Saturn Turbine have regulated emissions with enforceable limitations on their PTE. Clarify that for all other emissions units, the potential to emit was “unregulated” and “for informational purposes.”
- Removing the Emission Unit Specific Requirements for the Condensate Storage Tanks (T1 and T2) in Section 6.3, truck loading (L1) in Section 6.4, planned startup, shutdown, and maintenance (SSM) activities in Section 6.5 and piping, valve and flanges equipment leaks (F1) in Section 6.6.

Comments received from the public, other government agencies, and the applicant during the public comment period will also become part of the administrative record for the Harvest Compressor Station Title V renewal permit action. Public Hearing:
You have the right to request a public hearing on the proposed reopened for cause permit action only on the reopened and revised portions of the proposed permit. Any request for a public hearing must be received by EPA no later than September 17, 2025, and the request must state the nature of the issues proposed to be raised in the hearing for the permit action. Any request for a public hearing must be provided to EPA by posting a request on the Regulations.gov website listed above under Docket ID EPA-R06-OAR-2025-0220. Please note attendance/participation at a public hearing is not required in order to submit written comments. If EPA determines that there is significant public interest in the permit action, a virtual public hearing will be held on October 15, 2025, for the virtual public hearing on our public notice website at https://www.epa.gov/publicnotices/notices-search/location/new%20mexico .
Due to the logistics involved in planning a virtual meeting, a pre-registration period will be necessary and will last from October 6, 2025, until October 10, 2025. For participants not able to pre-register, EPA will allow time for individuals attending and wanting to speak to participate, at the end of the meeting as participants indicate their interest to speak, and as time allows. EPA will send verification by e-mail to all participants who pre-register to inform them of the order of speakers registered and approximate times for speakers to provide their verbal comments during the public hearing.
If a public hearing is held, the public comment period shall automatically be extended to the close of the public hearing date. EPA retains the right to cancel the scheduled public hearing if no request for a public hearing is received by September 17, 2025, or if EPA determines that there is not a significant interest. If EPA decides to cancel the public hearing, notification of the cancellation will be posted by September 22, 2025, on the Regulations.gov website listed above and also on EPA’s website at https://www.epa.gov/publicnotices/notices-search/location/new%20mexico .
Final Determination:
A final decision to issue or to deny a permit shall be made after all comments have been considered. Notice of the final decision shall be sent to each person who has submitted comments or requested notice of the final permit decision, provided the EPA has adequate contact information.
