Proposed Approval
On September 10, 2026, EPA announced a proposal to approve the Wisconsin Department of Natural Resources’ application to allow the Wisconsin DNR CCR permit program for CCR landfills to operate in lieu of the federal CCR program. EPA preliminarily determined that the Wisconsin CCR permit program meets the standard for approval under the Resource Conservation and Recovery.
EPA will accept comments on this proposal for 60 days after Federal Register publication.

Background
EPA received an application from the state of Wisconsin requesting partial approval of their coal combustion residuals permit program. In preparation to submit their application, Wisconsin promulgated regulations for CCR disposal units, permitting requirements, and public notice and public hearing procedures, into Wisconsin Administrative Code Chapters Department of Natural Resources 500; 504-524; Environmental Protection - Solid Waste Management.
EPA took the first step in the process of making a determination of whether to approve WDNR's CCR permit program by notifying WDNR that their application is complete and that the formal process of soliciting public comment and making a final determination on WDNR's CCR permit program will begin.
