Public Hearing on the Coal Combustion Residuals (CCR) Management Unit Deadline Extension Proposed Rule

On July 22, 2025, EPA published a direct final rule and companion proposal creating an additional option for certain owners and operators to comply with the Facility Evaluation Report (FER) Part 1 requirements and to extend compliance deadlines for the remaining CCRMU provisions. In addition to accepting written comments, EPA will hold an online public hearing. The public hearing will provide interested persons the opportunity to present information, comments, or views concerning EPA's proposal.

General Information

EPA will hold an online public hearing about this proposal on September 12, 2025. The hearing will convene at 9:00 a.m. Eastern Time (ET) and conclude at 1:00 p.m. ET. If necessary, the hearing may go later to accommodate all those wishing to speak.

Oral testimony will be limited to five minutes for each person. EPA may ask clarifying questions during the oral presentations but will not respond formally during the hearing to any comments or information presented at the hearing. A verbatim transcript of the hearing will be included in the docket for this action. 

EPA will accept written public comments through Regulations.gov until the close of the comment period on this action.

EPA is providing 30–days' notice of this public hearing. EPA evaluated the complexity and technical nature of the proposed rule. The scope of the proposed rule is limited to establishing an additional option for owners or operators of active CCR facilities or inactive CCR facilities with a legacy CCR surface impoundment to comply with the facility evaluation report (FER) Part 1 requirements and to extending compliance deadlines for the remaining CCRMU provisions published in the Federal Register on May 8, 2024. EPA determined these issues are not complex or highly technical and therefore 30 days' notice of the public hearing for this proposed rule was adequate to provide the public with meaningful opportunity to comment on the proposed regulatory changes.

EPA will consider such requests on a first-come, first-serve basis during the hearing as time permits.
