On May 12, 2025, EPA announced a proposal to approve the application submitted by the North Dakota Department of Environmental Quality (ND DEQ) to allow the North Dakota Coal Combustion Residuals state permit program to operate in lieu of the federal CCR program. In addition to accepting written comments, EPA held a hybrid in-person and online public hearing. The public hearing provided interested persons the opportunity to present information, comments, or views concerning EPA's proposal.
