City of Hammond, Indiana, Combined Sewer Overflow Settlement Water Act Settlement
On June 17, 1999, the original Consent Decree in this matter was entered by the District Court, put the Hammond Sanitary District (HSD) on an enforceable schedule to, among other things, undertake remedial measures by 2010 to address to address its combined sewer overflows and dry weather overflows. Specifically, the settlement requires HSD to construct facilities in order to eliminate the use of three combined sewer overflow points, including a new wastewater storage reservoir; to make improvements to pump stations and sewer interceptors; and, to complete sewer separation. Under the settlement, HSD is also required to pay civil penalties totaling $225,000 to be divided equally between the United States and the State, and pay $2.1 million to a fund known as the Grand Calumet River Restoration Fund.
Prior to the June 17, 1999 entry, the settlement was lodged in April 1999 in the U.S. District Court of the Northern District of Indiana and was subject to a 30-day public comment period and final court approval.
