Can an interstate organization apply as part of a partnership and receive a subaward?
Interstate organizations are not eligible entity on their own, but the EN Grant Program had it confirmed from EPA competition lawyers that an interstate organization can partner with one of the member states, as long as that member state agency is the lead applicant (as that is the eligible entity under our program). For example: If the Interstate agency included Wisconsin, Indiana and Illinois and they wanted to partner with a state agency within Illinois, that would be possible, as long as the Wisconsin agency was the lead applicant.
The lead applicant cannot be submitting another application (either as an individual applicant or as part of another partnership) in the same grant cycle. So, if you were to opt for Illinois Department of Health as a partner, but Illinois Department of Environmental Quality also submitted an application in FY25, only one of the two applications would be eligible.
You also could just elect to work with another state or Tribal government altogether, but again, they could not be participating in another FY25 EN application.
