Rule Summary

On May 8, 2026, EPA withdrew this proposal. EPA concluded that the proposed revisions would have complicated, rather than contributed to, efficient implementation of cleanup at hazardous waste facilities under the Resource Conservation and Recovery Act. EPA also concluded that the existing regulations provide the tools necessary to develop protective permit conditions without the need to modify the hazardous waste definition. This action will maintain existing public health protections while avoiding confusion.

Rule History

On February 8, 2024, EPA proposed changes that would have amended the definition of hazardous waste as it applies to corrective action to address releases from solid waste management units at permitted hazardous waste treatment, storage, and disposal facilities. 

EPA welcomed comment on this proposal through March 26, 2024.
