Complaints and Petitions for Review
Many of the environmental statutes contain provisions that allow citizens to sue EPA when EPA allegedly fails to perform an act or mandatory duty required by the statute. Citizens may also file petitions for review in courts to challenge actions taken by EPA. The table below contains complaints and petitions for review received by EPA. Complaints are added as they are received. Many complaints include multiple parties or petitioners. Please use the search feature to search for complaints filed by a specific group or individual. + WOTUS means “waters of the United States” and is the term that generally defines the scope of federal protection of surface waters under the federal Clean Water Act. WOTUS litigation refers to challenges to rules defining that term issued by the EPA and the Department of the Army, Army Corps of Engineers. Both agencies administer permitting programs under the Clean Water Act.
