Background
The US Ecology, Wayne Disposal, Inc. (WDI) facility would be allowed to modify the liner design for several cells of its landfill if a proposed modification to its existing polychlorinated biphenyl (PCB) chemical waste landfill approval is granted by the U.S. Environmental Protection Agency (EPA). The modification would occur within the original boundaries of the facility located at 49350 North I-94 Service Drive, Belleville, Michigan.
In January 2021, WDI requested that EPA modify the company’s existing approval for a chemical waste landfill to dispose of PCBs. The modification request includes (1) a change to the design of Master Cell VI Subcells F1 through F4 and MC VI Subcells G4 through G7 to incorporate Geosynthetic Clay Liner (GCL) into the baseliner system and (2) the addition of two leachate collection and leak detection sumps. In July 2021, WDI submitted a revision to the January 2021 modification request to revise the liner grades of Master Cell VI Subcells F1 through F4.
WDI first received approval to dispose of PCBs in the company’s chemical waste landfill in 1997. Permission to manage PCBs was last renewed in 2019. Approval of the liner modification request would allow WDI to continue to develop its current PCB capacity of 12 million cubic yards. The liner modification would be located in subcells of the landfill which have been previously approved to accept PCB wastes. EPA regulates PCB disposal under the federal Toxic Substances Control Act (TSCA).
The landfill is supervised by the Michigan Department of Environment, Great Lakes, and Energy (MEGLE) for hazardous waste disposal and received its most recent state operating permit for the landfill in 2012. States are not authorized for the TSCA PCB regulations and therefore, EPA issues approvals for PCB disposal at the landfill.
After reviewing WDI’s request, EPA tentatively plans to approve the major modification to the landfill design. Agency experts believe the company has shown that the modification is as protective as the previous liner design and does not present a risk to people or the environment.
Before a final decision is made, EPA took comments from the public on the proposed modification to the PCB chemical waste landfill approval for WDI located at 49350 North I-94 Service Drive, Belleville, Michigan.
The draft major modification to the PCB chemical waste landfill approval was open for public comment from November 1, 2021 to December 30, 2021. A virtual public hearing was hosted by MEGLE for both the modification to the MEGLE operating license and EPA approval for PCB disposal. The public hearing was held on December 1, 2021. Copies of the draft major modification to the PCB chemical waste landfill approval and supporting documents (i.e., WDI application) are located at the Belleville Area District Library as well as posted online (see below). Comments were accepted on the draft EPA major modification, not the supporting documents.
