Suspension of Registrations under FIFRA

The information on this webpage is intended to assist EPA and state enforcement staff in their efforts to ensure that suspended pesticide products are not being illegally marketed.

Suspension of a pesticide registration pursuant to FIFRA Section 3(c)(2)(B) generally halts further distribution and sale of the pesticide product by the registrant and any supplemental registrants or supplemental distributors until EPA lifts the suspension. 

Consumers who have purchased such products may continue to use them according to the labels.

Basis and Process for Suspension of Pesticide Products

As part of its regulatory process, EPA may determine that additional data are required to support an existing registration of a pesticide. In such cases, the Agency notifies all registrants of the pesticide through issuance of a FIFRA Data Call-In Notice or DCI. The DCI requires each affected registrant to provide evidence within 90 days that the affected registrant is taking appropriate steps to respond to the DCI. Additionally, the Notice sets deadlines for data submission and may specify interim deadlines.

If a registrant fails to comply with a DCI requirement, EPA may issue a Notice of Intent to Suspend (NOITS) the registration of the pesticide. If the registrant fails to submit timely or adequate data to satisfy the DCI or fails to take any additional step required by the DCI, EPA may suspend the pesticide. The suspension becomes final and effective 30 days after EPA issues the NOITS, unless within that time period, one of the following two things happens:

  • the registrant demonstrates that it has fully complied with the requirements that served as a basis for the notice of intent to suspend; or
  • a person adversely affected by the Notice makes a timely and adequate request for a hearing.

If a hearing is requested, it will be conducted according to the requirements of section 6(d) of FIFRA (U.S. Code Title 7, Chapter 6, subchapter II, section 136d(d)) and the Agency's Procedural Regulations at 40 CFR Part 164.

Current Suspensions

The pesticide product registrations listed in the table below are currently suspended.

Please note that this list is as accurate as possible. However, due to processing times and other issues, there could be suspended products that are not on the list or products whose suspension has been lifted that have not been removed from the list. Enforcement officials need to confirm the suspension status of the product with the appropriate EPA contact person before initiating any suspension-related enforcement action against any company whose product(s) may appear in the table below.
