EPA Proposes Correction to Rule for Pesticide Product Data Requirements

Today, EPA is announcing in the Federal Register a proposed rule to correct the language describing the "200 ppb level" in 40 CFR 158.2230(d). The proposed rule clarifies that the 200 ppb level does not refer to the amount of pesticide residue that might be present on a single food, which is what the current regulatory text incorrectly implies. Instead, it refers to the total amount of residue of a pesticide that an individual might consume per day.

This change offers the regulated community clearer, more understandable, and transparent information about the data required to support pesticide product registration decisions and does not impose any new burdens or costs. EPA has agreed to publish this proposed rulemaking correction by September 2, 2017. The Federal Register notice announcing the proposed rule is available at www.regulations.gov in Docket# EPA-HQ-OPP-2015-0683.
