Summary

EPA is providing notice of a proposed administrative penalty settlement with Custom Excavating by Dean Larson Inc. DBA: Trails End Recovery for violations of the Clean Water Act at its facility located in Warrenton, Oregon.

The 1200-Z general permit covers discharges of pollutants into Lewis and Clark River.

Alleged violations include failure to implement adequate control measures, failure to submit a discharge monitoring report, and failure to adequately implement Tier 1 corrective actions and maintain an adequate Stormwater Pollution Control Plan.

This action is being simultaneously commenced and concluded in a legal document called an Expedited Settlement Agreement. Under the proposed agreement, the respondent will pay a civil penalty of $10,020 and has certified that the alleged violations have been corrected.
