Summary

EPA is providing notice of a proposed administrative penalty settlement with UniSea, Inc., for violations of the Clean Water Act at its facility located in Dutch Harbor, Alaska.

EPA alleges that the respondent failed to comply with its National Pollutant Discharge Elimination System Multi-Sector General Permit (#AKR06AC21) at its Dutch Harbor facility. The permit covers discharges of pollutants into Iliuliuk Harbor.

Alleged violations include failure to eliminate non-stormwater discharges; failure to update the facility’s Stormwater Pollution Prevention Plan annually; and failure to include required contents in the facility’s Stormwater Pollution Prevention Plan map.

This action is being simultaneously commenced and concluded in a legal document called an Expedited Settlement Agreement. Under the proposed agreement, UniSea will pay a civil penalty of $5,859, and has certified that the alleged violations have been corrected.

Legal authority

This is a Class II administrative penalty proceeding governed by Section 309(g) of the Clean Water Act [33 U.S.C. § 1319(g)], and the procedural rules found at 40 CFR Part 22. The requirements that apply to public comment and participation are set forth in Clean Water Act Section 309(g)(4) and 40 CFR § 22.45.
