Presidential Proclamation – Regulatory Relief for Certain Stationary Sources to Promote American Energy
On Tuesday, April 8, 2025, the President signed a Proclamation exempting certain stationary sources, identified in Annex I of the Proclamation, from compliance with the “National Emissions Standards for Hazardous Air Pollutants: Coal- and Oil-Fired Electric Utility Steam Generating Units Review of the Residual Risk and Technology Review” (89 FR 38508) (the “Rule”). The White House subsequently transmitted Annex I to the EPA to inform the EPA which stationary sources are covered by the President’s exemption.
As set out in the Proclamation, the President’s exemption lasts for a period of 2 years beyond the Rule’s compliance date -- i.e., for the period beginning July 8, 2027, and concluding July 8, 2029. During the 2-year period these stationary sources identified in Annex I are subject to the compliance obligations that they are currently subject to under the Mercury and Air Toxics Standards (MATS) as the MATS existed prior to the Rule (89 FR 38508).
