Summary

The United States Environmental Protection Agency (EPA) Region 6 office in Dallas, Texas, proposes to grant re-authorization approval to Waste Control Specialists (WCS), located at approximately 30 miles west of Andrews, Texas on a 1338-acre tract of land one mile north of Texas Highway 176 for the storage and disposal of PCBs.  WCS has requested re-authorization to operate its existing storage and disposal facility. The landfill, with a total capacity of 5.95 million cubic yards, is currently authorized to accept both PCB and non‑PCB waste. The facility’s maximum authorized storage is 275,000 gallons and 3,510 cubic yards of PCB waste.

The EPA has authority to issue approvals for commercial storage and land disposal of PCBs under Section 6(e) of the Toxic Substances Control Act (TSCA) in accordance with regulations promulgated pursuant to 40 CFR § 761.65 and § 761.75. After reviewing all of the information submitted by WCS, EPA finds that the regulatory requirements for the operation of a commercial PCB storage and PCB land disposal facility have been met. The EPA has established a docket for this action under Docket ID No. EPA-R06-RCRA-2026-4093. All supporting materials are available under the docket at https://www.regulations.gov.

The EPA has determined under Section 106 of the National Historic Preservation Act that historic properties will not be affected by the proposed re-authorization. The EPA has determined under Section 7 of the Endangered Species Act that the proposed re-authorization will not affect any listed species or designated critical habitat.

This notice opens a 45-day comment period, beginning June 1, 2026, and ending July 16, 2026, during which requests may be made for a Public Hearing. The decision to hold a hearing is at the discretion of the EPA and will be based on factors such as the degree of public interest, the 
substance of comments, and whether a hearing is needed to clarify relevant issues. If the EPA determines that a Public Hearing should be convened, a 30-day advance notice of the date, time, and place of the Hearing will be published.
