PUBLIC COMMENTS

The Director shall provide public notice and an opportunity for public comment in accordance with the procedures in 40 C.F.R. Section 124.10 of the intent to approve or deny a petition. The public comment period will run from the date of publication of this Notice until 11:59 p.m. Eastern Standard Time (EST) on October 20, 2025. The public is invited to comment on the proposed reissuance decision by:

  1. Submitting written comments online at https://www.regulations.gov/docket/EPA-R06-OW-2025-1542  under Docket # EPA-R06-OW-2025-1542.
  2. EPA Region 6 encourages the electronic submittal of comments online at https://www.regulations.gov/docket/EPA-R06-OW-2025-1542.If you are unable to submit comments electronically or have any questions or require assistance with submitting comments, please contact Mr. Forrest Frederick at frederick.forrest@epa.gov or 214-665-6656.

All written comments must be received by the end of the comment period. All comments received before the end of the comment period and at the public hearing will be considered by the EPA in the formulation of any final petition determinations. Comments are given equal consideration regardless of how they are received. Note that comments MUST be submitted to EPA Region 6 using one of the methods above to be considered as part of the permitting decision by EPA Region 6.

The EPA is not required to hold a public hearing; however, if there is sufficient public interest in this proposed decision, the EPA may hold a public hearing. Request for a public hearing must be submitted in writing by email or mail to the EPA contacts and addresses provided above. A written request for a public hearing must be submitted before the 11:59 p.m. EST on October 20, 2025.  The EPA will give at least a 30-day notice if a public hearing will be held. Pertinent public comment and public hearing procedures for the EPA may be found in 40 C.F.R. Sections 124.10 and 124.12.

Summary

PURPOSE OF PUBLIC NOTICE 

This notice serves to state the intention of the U.S. Environmental Protection Agency (EPA), Region 6, to propose a reissuance of an exemption to the land disposal restrictions of the Hazardous and Solid Waste Amendments of 1984 (HSWA) to the Resource Conservation and Recovery Act (42 U.S.C. Section 6901, et seq) for the following facility:

                                                                        Houston, Texas 77015

                                              Wells:             WDW-147

                                                                        WDW-319

The proposed petition reissuance is for two (2) Class I injection wells that will be used to inject hazardous waste near Harris County, Texas. The petition reissuance requires, among other things, that the permittee monitor the injection project and submit periodic reports to EPA Region 6. Ongoing monitoring requirements are designed to ensure protection of underground sources of drinking water. 

The proposed reissuance decision was based on a detailed technical review of the submitted reissuance request with supporting documents. This notice also marks the opening to the public of a 45-day comment period during which the public may submit comments on EPA’s proposed action.

FACILITY INFORMATION

Merichem Company, originally constructed and operated WDW-147, using it to inject hazardous wastes. In 2000, Merisol USA, LLC. (formerly Merichem Company) was granted approval by EPA Region 6 to inject hazardous waste into WDW-319. Sasol Chemicals (USA), LLC (formerly Merisol USA, LLC) has been operating the wells for the primary purpose of hazardous waste disposal under this petition since June 28, 2006. An additional history of the facility is stated in the fact sheet. 

Sasol Chemicals (USA), LLC submitted a No-Migration Petition reissuance requesting a modification to the present Exemption Approval Conditions (referencing June 28, 2006, approval). The requested modification is for an extension of the operational life of the facility to December 31, 2050. All previously approved cumulative values remain unchanged as shown in the fact sheet. Sasol Chemicals has demonstrated that it's approved no migration petition continues to remain valid.
