List Of Insurance Providers For UST Financial Responsibility Requirements

This web page replaces EPA’s document, List Of Known Insurance Providers For Underground Storage Tank Owners And Operators. 

EPA’s financial responsibility requirement states that underground storage tank (UST) owners and operators pay the costs of cleaning up leaks from USTs and compensate third parties for bodily injury or property damage resulting from leaks. 40 CFR Part 280, Subpart H, the UST financial responsibility regulation, allows UST owners and operators to choose from a variety of financial mechanisms to comply with the regulation. One of the financial mechanisms is the use of insurance. 

EPA compiled this list of insurance providers based on information we received from them. UST owners and operators may find that these providers can help you obtain UST insurance that fulfills your financial responsibility obligation.

UST Owners And Operators Must Demonstrate Financial Responsibility

UST owners and operators must make sure the coverage you are offered meets federal requirements and state or local requirements that apply to your USTs. Under federal requirements, in order to fully demonstrate financial responsibility using an insurance policy, your insurance policy must provide coverage for taking corrective action and for compensating third parties for bodily injury and property damage caused by both nonsudden and sudden accidental releases arising from operating an UST. You should contact the state implementing agency where your UST is located to be sure that your insurance policy meets state requirements.  

Some insurance providers sell insurance policies that provide only partial coverage, for example coverage for only third-party liability. If you decide to purchase such a policy, you will need to demonstrate financial responsibility for the remaining coverage to fully comply with the federal requirements, for example through the use of another financial mechanism. It is your responsibility to understand what type of coverage is provided by your insurance policy. 

If your insurer adds your UST coverage to an existing policy, your insurer should provide you with an endorsement that conforms to the “Endorsement” criteria described in §280.97 of the financial responsibility rule at 40 CFR Part 280, Subpart H. If your insurer provides you with a new policy, it should conform to the “Certificate Of Insurance” standard also described in §280.97 of the financial responsibility rule. Who's Who? Insurance Provider, Agent, Broker

EPA’s list of insurance providers provides contact information for obtaining insurance for your USTs. An insurance provider is either the insurance company itself or an independent underwriter who provides policies on behalf of an insurance company. The insurance company is the party to the insurance contract who promises to pay losses or benefits.  

EPA’s list does not include agents or brokers. An agent is a person or organization who or which solicits, negotiates, or instigates insurance contracts on behalf of an insurer and can be independent or an employee of the insurer. A broker is an insurance intermediary who represents the insured rather than the insurer.
