Tribal NSR Implementation in EPA's South Central Region

EPA's South Central region  (Region 6) serves Arkansas, Louisiana, New Mexico, Oklahoma, Texas and 66 Tribes

R6 is the permitting authority for the NSR permits that include minor NSR, non-attainment NSR and the Prevention of Significant Deterioration ( PSD) as well as the Operating Permits program (Part 71) for 66 tribes.  Tribal registrations, notifications and permitting documents are requested to be sent electronically in a searchable Portable Document Format (PDF) or Microsoft Word, excel, or other database documents by email.

Note!  Sources planning to seek coverage under any NSR permit must first demonstrate it has adequately completed the processes to comply with Section 7 of the Endangered Species Act (ESA) and Section 106 of the National Historic Preservation Act (NHPA). For sources utilizing the permit by rule and General Permits, the source must receive a written letter from the EPA indicating that the processes have been satisfactorily addressed, prior to notifying the reviewing authority that it is covered under a permit by rule and/or General Permit 49.56(f)(6)(iii). For other NSR permitting actions, please reference the application forms for providing adequate information on the above two Acts for EPA’s review.

Applying for Permits - General Instructions

Proposed Construction of New Minor Modifications at Existing Major Sources – On or After August 30, 2011

  • Submit Form NEW only for pre-construction approval

New Minor Oil and Natural Gas Industry Sources – Constructed Between August 30, 2011 and October 3, 2016

  • Submit Form REG only within 90 days after you begin operating
  • No permit required

Proposed Construction of New Minor Sources or Minor Modifications at Existing Minor Sources (Except Oil and Natural Gas) – On or After September 2, 2014

  • Submit Form NEW only for pre-construction approval

Proposed Construction of New Minor Sources for Categories with Available General Permits/Permits by Rule – On or After Effective Date of General Permit/Permit by Rule

  • Follow specific instructions at EPA's Tribal Minor NSR web page for the specific source category

Proposed Construction of New True Minor Oil and Natural Gas Sources or Minor Modifications at Existing Minor Oil and Natural Gas Sources – On or After October 3, 2016

  • Follow specific instructions at EPA's Tribal Minor NSR web page

If your source is located within the exterior boundaries of any of the following Reservations full authority for Minor NSR permitting has been approved (or delegated) by EPA for the associated governing Tribes and you should work with that Tribe in order to comply with applicable permitting requirements. Each listed Reservation/Tribe contains a link to contact information for the approved Tribe's permitting program.
