City of Euclid, Ohio Combined and Sanitary Sewer Overflow Clean Water Act Settlement

On October 14, 2011, a Consent Decree in this matter was entered by the District Court, put the City of Euclid (the City) on an enforceable schedule to complete remedial measures by 2026 to address its combined sewer and separate sanitary sewer overflows from its sewer system that have been contributing to the impairment of creeks or streams that flow into Lake Erie, as well as the Lake itself.

Specifically, the settlement requires, among other things, that the City: expand capacity at its wastewater treatment plant to allow for treatment of tens of millions of gallons of wastewater combined with storm water or snowmelt during and after wet weather events; and, complete measures, including expansion of its sewer system infrastructure, that will eliminate within nine years, all discharges of sanitary sewage from the sanitary portions of its sewer system. Under the settlement, the City is also required to pay civil penalties totaling $150,000 to be divided equally between the United States and the State.

Prior to the October 14, 2011 entry, the settlement was lodged in U.S. District Court of the Northern District of Ohio and was subject to a 30-day public comment period and final court approval.
