Establishment of New EPA General Terms and Conditions

Notification Date:  August 11, 2023

Purpose:  This Recipient/Applicant Information Notice (RAIN) informs recipients of the addition of new General Terms and Conditions.

Summary:  The Office of Grants and Debarment (OGD) has updated the EPA General Terms and Conditions Effective October 1, 2022 or later to add five new terms and conditions.

The new terms and conditions are as follows:

• #40. Post-Award Disclosure of Current and Pending Support on Research Grants - Requires post-award reporting of any new foreign support of for EPA research grants.
• #49. Required Certification and Consequences of Fraud - Informs grant recipients and subrecipients of the need for truthful conduct and the consequences of fraud.
• #50. Reporting Waste, Fraud, and Abuse - Includes information regarding reporting fraud, waste, and abuse to the Office of Inspector General (OIG) and requires the display of OIG Hotline posters for awards of $1 million or more.
• #51. Whistleblower Protections - Includes information regarding whistleblower protections.
• #52. Access to Records - Includes the requirement that

Action:  The new terms and conditions apply to all new EPA awards and funding amendments made on or after August 8, 2023. Questions about the implementation of the new terms and conditions should be directed to the EPA Project Officer and Grant Specialist.
