Public Notice: Opportunity to Comment on Draft Permit for the Yellowstone National Park Pesticide Permit in Wyoming
Summary
The EPA Region 8 intends to issue a National Pollutant Discharge Elimination System (NPDES) permit under the authority of Section 402 of the Clean Water Act.
Activity
Pesticide application performed by the National Park Services, related to several native fish restoration projects, for the removal of nonnative fish found within the proposed work area. The GPS locations within the Yellowstone National Park for the beginning and end of the project areas for pesticide application into receiving waters are as follows:
- Buffalo Creek: Latitude: 45.028429, Longitude: -110.301223 to Latitude: 44.949731, Longitude: -110.307854
- Tower Creek: Latitude: 44.790268, Longitude: -110.542800 to Latitude: 44.894832, Longitude: -110.383661
- Carnelian Creek: Latitude: 44.801551, Longitude: -110.466256 to Latitude: 44.894832, Longitude: -110.383661
Authorization to discharge for pesticide application is limited to these pest management areas/locations, as specifically listed in the Permit. The facility will not be using or disposing of sludge as part of these permitted activities.
Public Comments
The public comment period ends 30 calendar days after the date of publication of this notice. Any interested person may submit written comments on the draft permit. Comments should be directed to Alysia Tien at the address listed in the box at right. If you cannot adequately address comments via email, please reach out to Ms. Tien at the contact information provided to discuss alternative arrangements. All comments received prior to the end of the comment period will be considered in the formulation of any final permit determination and will be part of the administrative record. Any interested person may request a public hearing and the EPA will hold a hearing if the response to this notice indicates significant public interest. The EPA is also requesting comments on the possible adverse effects of reissuing the permit on historic properties and/or cultural resources in the area. The EPA is the Clean Water Act (Act) Section 401 certifying authority for this draft permit because the permitted area is located on Lands of Exclusive Federal Jurisdiction within Yellowstone National Park. The EPA is also seeking comment on Section 401 certification considerations.
