PRN 98-10: Notifications, Non-Notifications and Minor Formulation Amendments

  • Expedited Review for Products Adding Residual Efficacy Claims

The temporary amendment to PRN 98-10, signed May 11, 2020—which included the provisions in the temporary amendments from March 30 and April 14, 2020—allowed registrants to notify EPA of certain formulation and manufacturing facility changes and immediately release the product for sale without waiting for EPA approval. In the temporary amendment, EPA emphasized that this regulatory flexibility was time-limited.

On September 15, 2021, the Agency announced the termination of the temporary amendment effective September 15, 2022, and that any changes made using the temporary amendment must be made permanent by Sept. 15, 2022. The Agency requires additional time to complete the review and approval of the notifications and amendments to make these changes permanent and is therefore extending the deadline to March 15, 2023. 

For submittals received after September 15, 2022, EPA cannot guarantee that review will be completed by the March 15, 2023, termination date. These submittals will be processed under normal, not expedited timeframes.
