Public Notice: Proposed Settlement of CWA Section 309(g) Class I Administrative Penalty; Core Tech-HDCC-Kajima LLC, Tamuning, GU
Summary
EPA is providing notice of a proposed administrative penalty settlement with Core Tech-HDCC-Kajima LLC (Respondent) for violations of the Clean Water Act (CWA). EPA alleges that Respondent violated the CWA and failed to comply with the condition(s) or limitation(s) of a duly issued permit pursuant to Section 402 of the Act, 33 U.S.C. § 1342, and Section 301(a) of the Act, 33 U.S.C. § 1311(a). Specifically, EPA alleges that the company’s construction activities at project J-609 Apra Embarkation Facility did not fully comply with the requirements of EPA’s 2022 Construction General Permit.
Pursuant to Section 309(g) of the CWA, 33 U.S.C. § 1319(g), and in accordance with 40 C.F.R. Part 22 (consolidated rules of practice for assessing administrative civil penalties), EPA proposes entering into a Consent Agreement and Final Order (CA/FO) with Respondent to simultaneously commence and conclude this CWA Class I civil administrative penalty proceeding. Under the proposed CA/FO, Respondents have already documented corrective actions to address all non-compliance at the General Permit and have agreed to pay the United States a civil penalty of $8,920 to resolve this matter.

Description of Business or Activity Conducted by the Respondents: Respondent is a general contractor and authorized legal operator of the construction project J-609 Apra Embarkation Facility. After submitting the Notice of Intent (permit authorization) to EPA, respondent was given NPDES Construction General Permit authorization for this project under NPDES ID Number GUR100063.
Summary of Alleged Violations: Respondent controlled daily project activities needed to follow permit rules and direct workers, and legally responsible for compliance and failed to comply with all permit requirements. Respondent discharged stormwater into waters of the United States in a manner that did not comply with their CWA permit.
