Summary

EPA announces a public hearing and extension of public comment period on the Class V Underground Injection Control permits for the Montalban Oil and Gas Jody Field 34-1 & 34-2 wells permits in Pondera County, Montana

A public hearing will be held in Conrad, Montana on Wednesday, April 3, 2024*, 6-8 pm

Action: The U.S. Environmental Protection Agency (EPA) under the authority of the Safe Drinking Water Act and UIC program regulations, is providing a public hearing and public comment period extension for two Underground Injection Control (UIC) Draft Permits and one associated proposed aquifer exemption expansion decision for the Montalban Oil and Gas Operations (MOGO) – Class V disposal wells (Jody Field 34-1 & 34-2). The Jody Field 34-1 and 34-2 wells are centrally located in Pondera County in Montana. The extended public comment period will close on April 8, 2024, 5 days after the public hearing.

Background: EPA is issuing two Draft UIC Permits to Montalban Oil and Gas Operations, for injection into the Madison Formation. The wells would be used for injection of industrial wastewater, generated from renewable feedstocks received from the Montana Renewables Fuels Refinery in Great Falls, which may include vegetable/used oils and animal fats. EPA has primacy for Class V permitting in MT.  With this action, the EPA is also proposing an aquifer exemption expansion approval in connection with the Class V Permit to exempt the lower portion of the previously exempted Madison Formation aquifer. At the close of the public comment period, the EPA will review and consider all comments received during the initial and extended comment periods and during the public hearing before making its final permit decisions. The EPA will also prepare a response to all the comments received that are relevant to the UIC Class V Draft UIC Permits. Pre-hearing Informational Session: an informative session will be held prior to the hearing from 5:00 to 6:00 pm, Wednesday, April 3, 2024.

Public Hearing Information: The public hearing will follow the informational session and will be held from 6:00 p.m. to 8:00 p.m. The public may provide written and/or verbal comments during the EPA public hearing.
