EPA’s New Report Shows How Climate Change is Influencing Seasonal Events in the U.S. and Impacting Peoples’ Health and Environment
EPA is issuing a new report, Seasonality and Climate Change: A review of observed evidence in the United States, showing how climate change is affecting seasonal events and processes across the United States. Longer growing seasons, more heat waves, earlier snowmelt, and changes in leaf and bloom dates: These are just a few of the ways in which climate change is altering the nature of seasonal events. The report uses long-term historical data tracking dozens of climate indicators to describe these changes and how they affect physical, ecological and human systems, as well as our everyday lives.

EPA Region 7 Announces Opportunity to Apply for Farmer to Farmer Grant Funding
The U.S. Environmental Protection Agency (EPA) has announced the availability of $12 million in funding to support historically underserved farmers within the Gulf of Mexico watershed through the Farmer to Farmer grant program. Waters in EPA Region 7 are within this watershed.

The Federal-State On-Farm Compost Work Group is pleased to announce the launch of an On-Farm Compost Resource Website. The resources on this website include information and tools to help farmers and ranchers compost agricultural byproducts, including manure, and maintain compliance with federal, state, and local regulations.

EPA Announces $12 Million for Historically Underserved Farm-Focused Projects in the Gulf of Mexico Watershed
The U.S. Environmental Protection Agency’s (EPA) has announced the availability of $12 million in funding to support historically underserved farmers within the Gulf of Mexico watershed through the Farmer to Farmer grant program. Selected projects will work to increase collaboration among farming communities, while improving water quality, habitat, climate resilience and environmental education through the demonstration of innovative practices on working lands.
EPA Announces Appointments of Regional Administrators for Regions 6, 7, and 9
U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced that President Biden will appoint three new Regional Administrators to lead EPA’s work protecting human health and the environment in their respective regional offices. The following individuals will be appointed: Dr. Earthea Nance will become EPA’s Regional Administrator for Region 6. Nance will lead the implementation of the Biden-Harris environmental agenda in Arkansas, Louisiana, New Mexico, Oklahoma, Texas and with 66 Tribal Nations. Meg McCollister will become EPA’s Regional Administrator for Region 7. McCollister will lead the implementation of the Biden-Harris environmental agenda in Iowa, Kansas, Missouri, Nebraska and with nine Tribal Nations. Martha Guzman will become EPA’s Regional Administrator for Region 9. Guzman will lead the implementation of the Biden-Harris environmental agenda in Arizona, California, Hawaii, Nevada, the Pacific Islands, and 148 Tribal Nations.
EPA Announces Appointment of Meg McCollister as Regional Administrator for EPA Region 7
Today, U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced that President Biden will appoint Meg McCollister to become EPA’s Regional Administrator for Region 7. McCollister will lead the implementation of the Biden-Harris environmental agenda in Iowa, Kansas, Missouri, Nebraska, and nine tribal nations.
U.S. EPA Requires Giumarra Vineyards in Bakersfield to Improve Chemical Safety
The U.S. Environmental Protection Agency (EPA) announced a settlement with Giumarra Vineyards Corporation) for alleged violations of Clean Air Act chemical safety requirements. The violations pertain to the facility’s anhydrous ammonia refrigeration system that is used for grape packing and storage. Under the terms of the consent agreement and final order with EPA, Giumarra will pay $188,882 in civil penalties and make significant safety improvements to the facility to ensure protection of the public and first responders from dangerous chemicals.

EPA Proposes Comprehensive Set of Biofuels Program Updates and Improvements
To strengthen the role of the Renewable Fuel Standard (RFS) in advancing greater use of low-carbon renewable fuels, the Environmental Protection Agency (EPA) proposed a package of actions setting biofuels volumes for years 2022, 2021, and 2020, and introducing regulatory changes intended to enhance the program’s objectives. In addition, EPA is seeking public comment on a proposed decision to deny petitions to exempt small refineries from their obligations under the RFS on the grounds that petitioners failed to show that EPA has a basis under the Clean Air Act (CAA) and recent federal case law to approve them. Together, these actions reflect the Biden Administration’s commitment to reset and strengthen the RFS program following years of mismanagement by the previous administration and disruptions to the fuels market stemming from the COVID-19 pandemic.

This regulation establishes tolerances for residues of bifenthrin in or on multiple commodities which are identified and discussed later in this document. The Interregional Project Number 4 (IR–4) and FMC Corporation requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). (December 1) - Cyflumetofen; Pesticide Tolerances
This regulation establishes a tolerance for residues of cyflumetofen in or on hop, dried cones. The Interregional Project Number 4 (IR–4) requested this tolerance under the Federal Food, Drug, and Cosmetic Act (FFDCA). (December 6) - Isoprothiolane; Pesticide Tolerances
This regulation establishes tolerances for residues of isoprothiolane in or on banana; rice, bran; rice, husked; and rice, polished rice. Nichino America, Inc. requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). (December 6) - 2,5-Furandione, Polymer With Ethenylbenzene, Octyl Imide, Imide With Polyethylene-Polypropylene Glycol 2-Aminopropyl Me Ether; Tolerance Exemption
This regulation establishes an exemption from the requirement of a tolerance for residues of 2,5-furandione, polymer with ethenylbenzene, octyl imide, imide with polyethylenepolypropylene glycol 2-aminopropyl Me ether, when used as an inert ingredient in a pesticide chemical formulation. Spring Regulatory Sciences, on behalf of Colorants Solutions USA LLC, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 2,5-furandione, polymer with ethenylbenzene, octyl imide, imide with polyethylene-polypropylene glycol 2-aminopropyl Me ether (CAS Reg. No. 1812871–29–6) on food or feed commodities. (December 6) - Pesticide Registration Maintenance Fee: Notice of Receipt of Requests To Voluntarily Cancel Certain Pesticide Registrations
In accordance with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA is issuing a notice of receipt of requests by registrants through 2020 Pesticide Registration Maintenance Fee responses to voluntarily cancel certain pesticide registrations. EPA intends to grant these requests at the close of the comment period for this announcement unless the Agency receives substantive comments within the comment period that would merit its further review of the requests, or unless the registrants withdraw its requests. If these requests are granted, any sale, distribution, or use of products listed in this notice will be permitted after the registrations have been cancelled only if such sale, distribution, or use is consistent with the terms as described in the final order. (December 7) - Trichoderma harzianum Strain T-78; Exemption From the Requirement of a Tolerance
This regulation establishes an exemption from the requirement of a tolerance for residues of Trichoderma harzianum strain T-78 in or on all food commodities when used in accordance with label directions and good agricultural practices. This regulation eliminates the need to establish a maximum permissible level for residues of Kosakonia cowanii strain SYM00028 under FFDCA when used in accordance with this exemption. This document notifies the public as required by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) that the EPA Administrator has forwarded to the Secretary of the United States Department of Agriculture (USDA) a draft regulatory document concerning ‘‘Pesticides; Certification of Pesticide Applicators; Extension to Expiration Date of Certification Plans (RIN 2070–AL00).’’ The draft regulatory document is not available to the public until after it has been signed and made available by EPA. This regulation establishes tolerances for residues of pyflubumide in or on tea, dried and tea, instant. Nichino America, Inc. requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). (December 15) - α-Terpineol (CAS No. 98–55–5); Tolerance Exemption
This regulation establishes an exemption from the requirement of a tolerance for residues of a-terpineol (CAS No. 98–55–5) when used as a solvent inert ingredient in pesticide formulations at rates of 5% of the formulation in pre-harvest applications to crops. Landis International, Inc., on behalf of Morse Enterprises Limited, Inc. d/b/a KeyPlex submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of aterpineol (CAS No. 98–55–5) on food or feed commodities when used in accordance with this exemption. (December 16) - Pesticide Product Registration; Receipt of Applications for New Active Ingredients—December 2021
EPA has received applications to register pesticide products containing active ingredients not included in any currently registered pesticide products. Pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA is hereby providing notice of receipt and opportunity to comment on these applications. (December 17) - Pesticides; Certification of Pesticide Applicators; Extension to Expiration Date of Certification Plans
The Environmental Protection Agency (EPA) is extending the expiration deadline of existing Federal, state, territory, and tribal certification plans. This deadline was established in 2017 when the EPA promulgated a final rule revising the Certification of Pesticide Applicators (CPA) regulations to improve the competency of certified applicators of restricted use pesticides (RUPs), increase protection for noncertified applicators using RUPs under the direct supervision of a certified applicator through enhanced pesticide safety training and standards for supervision of noncertified applicators, and establish a minimum age requirement for certified and noncertified applicators using RUPs under the direct supervision of a certified applicator. Federal, state, territory, and tribal certifying authorities with existing certification plans were required to revise their existing certification plans to conform with the updated Federal standards for the certification of applicators of RUPs and submit their revisions for EPA review in March 2020. The existing plans are set to expire on March 4, 2022, unless the revised plans are approved by the Agency. EPA is extending the existing plans’ expiration deadline to November 4, 2022. This will allow additional time for proposed certification plan modifications to continue being reviewed and approved by EPA without interruption to federal, state, territory, and tribal certification programs or to those who are certified to use RUPs under those programs. The extension also provides EPA with additional time to issue a proposed rule and seek public comment on the need for extending the expiration date beyond November 4, 2022. This notice announces EPA’s receipt of application 91868–EUP–R from Biotalys NV, Buchtenstraat 11, requesting an experimental use permit (EUP) for the ASFBIOF01–02. The Agency has determined that the permit may be of regional and national significance. Therefore, because of the potential significance, EPA is seeking comments on this application. EPA and Army Take Action to Provide Certainty for the Definition of WOTUS
The U.S. Environmental Protection Agency (EPA) and U.S. Department of the Army (the agencies) announced a proposed rule to re-establish the pre-2015 definition of “waters of the United States” (WOTUS) which had been in place for decades, updated to reflect consideration of Supreme Court decisions. This action advances the agencies’ goal of establishing a durable definition of WOTUS that protects public health, the environment, and downstream communities while supporting economic opportunity, agriculture, and other industries that depend on clean water. This proposed rule would support a stable implementation of “waters of the United States” while the agencies continue to consult with states, Tribes, local governments, and a broad array of stakeholders in both the implementation of WOTUS and future regulatory actions.
EPA Announces Appointments of Regional Administrators for Regions 2, 4, and 8
U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced that President Biden will appoint three new Regional Administrators to lead EPA’s work protecting human health and the environment in their respective regional offices. Lisa Garcia will become EPA’s Regional Administrator for Region 2. Garcia will lead the implementation of the Biden-Harris environmental agenda in New Jersey, New York, Puerto Rico, the U.S. Virgin Islands and eight Indian Nations. Daniel Blackman will become EPA’s Regional Administrator for Region 4. Blackman will lead the implementation of the Biden-Harris environmental agenda in Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, Tennessee and with six Tribes. KC Becker will become EPA’s Regional Administrator for Region 8. Becker will lead the implementation of the Biden-Harris environmental agenda in Colorado, Montana, North Dakota, South Dakota, Utah, Wyoming and with 28 Tribal Nations.

Administrator Regan Travels to Glasgow for COP26 to Participate in Events Focused on Climate Action
From November 9 through November 11, EPA Administrator Michael S. Regan will participate in the 26th Conference of the Parties (COP26) to the United Nations Framework Convention on Climate Change (UNFCCC), in Glasgow, United Kingdom. Throughout COP26, Administrator Regan will focus on initiatives and partnerships with other countries, the private sector, and civil society to mobilize ambitious action in key areas, including methane pollution, clean energy, HFC enforcement, efficient cookstoves, zero emission vehicles, industrial decarbonization, and adaptation. In his engagements, Administrator Regan will underscore the role EPA is playing to deliver on President Biden’s ambitious climate agenda that will grow the economy and create good paying jobs, the importance of environmental justice, and the impact of young leaders on taking meaningful action.

This regulation increases a tolerance for residues of benzobicyclon in or on rice grain and removes any restriction on regional use. Gowan Company requested this tolerance increase under the Federal Food, Drug, and Cosmetic Act (FFDCA). (November 2) - EPA Fines Pesticide Applicator for Alleged Violations of Federal Pesticide Law on Kansas Farms
The U.S. Environmental Protection Agency (EPA) penalized Nutrien Ag Solutions Inc. for allegedly applying pesticides that were cancelled by the federal government and applying them in a manner inconsistent with the products’ labeling. The Colorado-based company, which sells, distributes, and applies pesticides mainly for farming operations, will pay $668,100. The U.S. Environmental Protection Agency (EPA) announced a settlement with pesticide applicator TriCal Inc., based in Gilroy, California, resolving violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The EPA partnered with State and Fresno County authorities on this case. Under the terms of the settlement, TriCal will pay a civil penalty of $44,275. (November 18) - Product Cancellation Order for Certain Pesticide Registrations; Amendment
EPA issued a notice in the Federal Register on December 21, 2020 to amend the effective date of cancellation for the two spirodiclofen registrations listed in Table 1B of the cancellation order published in the Federal Register on April 13, 2018. The affected registrations for that cancellation order, EPA Registration Nos. 264–830 and 264–831 were registered to Bayer CropScience. EPA and USDA Announce Winners of the Next Gen Fertilizer Innovations Challenge
The U.S. Environmental Protection Agency (EPA) announced the winners of the Next Gen Fertilizer Innovations Challenge, the second of a two-part, joint EPA-US Department of Agriculture (USDA) Partnership and Competition on Enhanced Efficiency Fertilizers (EEFs) to Advance Agricultural Sustainability in the United States. The goal of the competition is to improve the efficiency of fertilizers to increase crop yields while reducing the impacts of fertilizers on the environment.

EPA Celebrates the Sixth Annual Children’s Environmental Health Day
The U.S. Environmental Protection Agency (EPA) celebrates the sixth annual Children’s Environmental Health Day, along with Children’s Health Month, highlighting actions to protect children from environmental hazards that impact their health. “Protecting the health of our children and the environment where they live, learn and play is central to EPA’s mission, especially children in overburdened and underserved areas,” said EPA Administrator Michael S. Regan. “As we celebrate Children’s Environmental Health Day, I think of the kind of world we want to leave for the next generation and the generations to come, and the work ahead of us to deliver justice and equity for all.”

EPA, Army Announce Regional Roundtables on WOTUS
The U.S. Environmental Protection Agency (EPA) and U.S. Department of the Army (the agencies) called on communities to propose roundtables to provide input on the regional implications of “waters of the United States” (WOTUS). The regional roundtables will engage stakeholders representing diverse perspectives in meaningful dialogue to help inform the agencies’ work to develop an enduring definition of WOTUS that supports public health, environmental protection, agricultural activity, and economic growth.

U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced that President Biden will appoint Adam Ortiz to become EPA’s Regional Administrator for Region 3. U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced that President Biden will appoint Debra Shore to become EPA’s Regional Administrator for Region 5. EPA Announces Appointment of Rod Snyder as EPA Agriculture Advisor
U.S. Environmental Protection Agency (EPA) Administrator Michael S. Regan announced the appointment of Rod Snyder to become EPA’s Agriculture Advisor. Snyder will lead outreach and engagement efforts with the agricultural community for EPA, working to advance the Biden-Harris environmental agenda for farmers and rural communities.
EPA Settlement with Reckitt Benckiser Resolves Violations Related to Sales of Mislabeled Rodenticides
In an enforcement action that illustrates vigilance to ensure compliance with the law, the U.S. Environmental Protection Agency (EPA) today announced a settlement with Reckitt Benckiser, LLC, that resolves violations of federal pesticide laws by the company for selling and distributing two rodenticide products in the United States that had misleading advertising claims on their packaging. Reckitt Benckiser will pay a civil penalty of $458,000 under the settlement to resolve these violations.
EPA Publishes its 2021 Climate Adaptation Action Plan
The U.S. Environmental Protection Agency (EPA) released its Climate Adaptation Action Plan, which describes steps EPA will take to address the impacts of climate change on communities across the Nation, as part of President Joe Biden’s whole-of-government approach to confronting the climate crisis. EPA also launched a new Climate Adaptation web page that will act as a hub for climate adaptation resources from across EPA.

EPA Releases Draft Strategic Plan to Address Climate Change and Advance Environmental Justice and Equity

The U.S. Environmental Protection Agency announced today that it has reached a settlement with EcoLab, Inc., in Tacoma, Washington over violations of federal hazardous waste and pesticides laws that resulted in a fire involving hazardous waste at the company’s facility on the Tacoma Tideflats and the hospitalization of a nearby worker. Under the settlement, EcoLab addressed the violations and agreed to pay a total penalty of $214,407. (October 22) -

EPA Rescinds Previous Administration’s Guidance on Clean Water Act Permit Requirements
The U.S. Environmental Protection Agency (EPA) is rescinding a guidance document entitled “Applying the Supreme Court’s County of Maui v. Hawaii Wildlife Fund Decision in the Clean Water Act Section 402 National Pollutant Discharge Elimination System Permit Program” that was issued by the Trump administration on January 14, 2021. With this action, EPA is preserving longstanding clean water protections.

EPA and Justice Department Reach Clean Air Act Settlement with Xtreme Diesel Performance, Ending Sale of Defeat Devices
Xtreme Diesel Performance (XDP), an automotive parts manufacturer and retailer based in Wall Township, New Jersey, with a sales distribution center in Las Vegas, Nevada, has agreed to stop manufacturing and selling parts for diesel pickup trucks that, when installed, bypass, defeat, or render inoperative EPA-approved emission controls and harm air quality, as part of an agreement to resolve alleged Clean Air Act violations. The company will pay a $1,125,000 penalty, which was reduced due to XDP’s limited financial ability to pay a higher penalty.

Administrator Regan Discusses Climate Change and Environmental Justice with Mexico and Canada at CEC Council Session
EPA Administrator Michael S. Regan joined representatives from Canada and Mexico virtually as he chaired the 28th annual session of the Commission for Environmental Cooperation (CEC) Council. Administrator Regan was joined by Mexican Secretary of Environment and Natural Resources María Luisa Albores González and Canadian Assistant Deputy Minister for the Environment and Climate Change Catherine Stewart. This year’s Council Session focused on Climate Change and Environmental Justice Solutions, highlighting the importance of addressing climate impacts and protecting the health of our communities, including those vulnerable communities that are facing disproportionate impacts.

EPA Announces Plans for New Wastewater Regulations, Including First Limits for PFAS, Updated Limits for Nutrients
The U.S. Environmental Protection Agency (EPA) released Preliminary Effluent Guidelines Program Plan 15 (Preliminary Plan 15), which identifies opportunities to better protect public health and the environment through regulation of wastewater pollution. Preliminary Plan 15 announces that EPA will undertake three new rulemakings to reduce contaminants including PFAS and nutrients—from key industries.
EPA Takes Action to Address Risks to Public Health by Proposing to Add Ochoa Fertilizer Co. in Guánica, Puerto Rico to the National Priorities List
The U.S. Environmental Protection Agency (EPA) announced that it is adding four sites to the National Priorities List (NPL) where releases of contamination pose significant human health and environmental risks. EPA is also proposing to add another 13 sites including Ochoa Fertilizer Co. in Guánica, Puerto Rico and is withdrawing a previously proposed site, following the Agency’s science-based determination that placing the site on the NPL is not needed to protect human health and the environment.

Notice of Receipt of Requests To Voluntarily Cancel Certain Pesticide Registrations
In accordance with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA is issuing a notice of receipt of requests by registrants to voluntarily cancel certain pesticide registrations. EPA intends to grant these requests at the close of the comment period for this announcement unless the Agency receives substantive comments within the comment period that would merit its further review of the requests, or unless the registrants withdraw their requests. If these requests are granted, any sale, distribution, or use of products listed in this notice will be permitted after the registrations have been cancelled only if such sale, distribution, or use is consistent with the terms as described in the final order. Cancellation Order for Certain Pesticide Registrations and Amendments To Terminate Uses; Correction
EPA issued a notice in the Federal Register of April 2, 2021, concerning the cancellations and amendments to terminate uses voluntarily requested by the registrants and accepted by the Agency. This document is being issued to correct the cancellation order in Table 1 of Unit I, by removing the registration number 66570–2 and Table 3 of Unit I, by removing EPA company number 66570, as these entries were made in error. Product Cancellation Order for Certain Pesticide Registrations
This notice announces EPA’s order for the cancellations, voluntarily requested by the registrants and accepted by the Agency, of the products listed in Table 1 of Unit II, pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This cancellation order follows a February 17, 2021 Federal Register Notice of Receipt of Requests from the registrants listed in Table 2 of Unit II to voluntarily cancel these product registrations. In the February 17, 2021 notice, EPA indicated that it would issue an order implementing the cancellations, unless the Agency received substantive comments within the 180-day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests. The Agency did not receive any comments on the notice. Further, the registrants did not withdraw their requests. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested cancellations. Any distribution, sale, or use of the products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions. Disapproval of Pesticide Product State Registrations for Special Local Needs
As provided under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), State designated lead agencies may register pesticides, within their respective States, to meet special local needs. EPA’s regulations require the State lead agencies to notify EPA of such special local need registrations. EPA may disapprove any such State registration. EPA’s regulations require that notice of disapproval actions be published in the Federal Register; as such this notice identifies special local need registrations which were disapproved by EPA on March 15, 2021, April 9, 2021, and April 23, 2021. Ortho-Phthalaldehyde; Receipt of Application for Emergency Exemption, Solicitation of Public Comment
EPA has received a specific exemption request from the National Aeronautics and Space Administration (NASA) to use the pesticide orthophthalaldehyde (OPA, CAS No. 643–79– 8) to treat the coolant fluid of the internal active thermal control system of the International Space Station to control aerobic/microaerophilic bacteria in the aqueous coolant. The applicant proposes the use of a new chemical which has not been registered by EPA. Therefore, in accordance with the Code of Federal Regulations, EPA is soliciting public comment before making the decision whether or not to grant the exemption. (September 15) -
Final National Pollutant Discharge Elimination System (NPDES) Pesticide General Permit for Point Source Discharges From the Application of Pesticides; Reissuance
This notice announces issuance by all 10 Environmental Protection Agency (EPA) Regions of the final 2021 National Pollutant Discharge Elimination System (NPDES) pesticide general permit (PGP)—the 2021 PGP. The 2021 PGP, which has an effective date of October 31, 2021, replaces the existing permit (2016 PGP) that expires at midnight on October 31, 2021, and authorizes certain point source discharges from the application of pesticides to waters of the United States in accordance with the terms and conditions described therein. EPA Announces $25 Million in Grants to Improve Drinking Water Quality for Underserved, Small, and Disadvantaged Communities

EPA Takes Action to Address Risk from Chlorpyrifos and Protect Children’s Health
The U.S. Environmental Protection Agency (EPA) announced it will stop the use of the pesticide chlorpyrifos on all food to better protect human health, particularly that of children and farmworkers. In a final rule released today, EPA is revoking all “tolerances” for chlorpyrifos, which establish an amount of a pesticide that is allowed on food. In addition, the agency will issue a Notice of Intent to Cancel under the Federal Insecticide, Fungicide, and Rodenticide Act to cancel registered food uses of chlorpyrifos associated with the revoked tolerances.

EPA Announces Resources to Help Partners Better Address Nutrient Pollution Affecting Waters
The U.S. Environmental Protection Agency (EPA) released three new resources to assist the agency’s state, territorial and authorized Tribal partners to address adverse effects of nutrient pollution, including freshwater harmful algal blooms (HAB). These resources will help EPA’s co-regulators and partners better protect recreators, aquatic life, and drinking water sources from the detrimental effects of nutrient pollution. The three resources include, the agency’s Final Recommended Nutrient Criteria for Lakes and Reservoirs, a web-based tool with information and tracking of HABs, and a Technical Support Document to aid implementation of certain HABs criteria.

EPA Finalizes New, Stronger Safety Measures for Pesticide Paraquat
The U.S. Environmental Protection Agency (EPA) is releasing the interim decision (ID) for the pesticide paraquat dichloride (paraquat) finalizing new, stronger safety measures to reduce exposure. The Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) requires the agency to periodically re-evaluate pesticides through registration review to ensure that risk assessments and pesticide decisions reflect the best available science. The ID is part of the legally required registration review process to identify risks as well as actions that can mitigate risks.

EPA and Army Announce Next Steps for Crafting Enduring Definition of Waters of the United States
The U.S. Environmental Protection Agency (EPA) and U.S. Department of the Army announced plans for upcoming community engagements to inform their efforts to revise the definition of “waters of the United States” (WOTUS) to better ensure clean and safe water for all. EPA and Army are committed to developing a reasonable, effective, and durable definition of WOTUS that protects public health, the environment, and downstream communities while supporting economic opportunity, agriculture, and other industries.

EPA Awards Nearly $1 Million to Help Farmers in Wisconsin
U.S. Environmental Protection Agency announced the Sand County Foundation in Madison, Wisconsin, will receive a $997,383 “Farmer to Farmer” grant to benefit communities and ecosystems in the Gulf of Mexico watershed. The foundation is one of 11 organizations receiving EPA funding to support the leadership of farmers in improving water quality, habitat, resilience and peer-to-peer information exchange.

This submission announces EPA’s order for the cancellations, voluntarily requested by the registrants and accepted by the Agency, of the products listed in Table 1 & Table 1A of Unit II, pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This cancellation order follows a May 11, 2021 Federal Register Notice of Receipt of Requests from the registrants listed in Table 2 of Unit II to voluntarily cancel these product registrations. In the May 11, 2021 notice, EPA indicated that it would issue an order implementing the cancellations, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests. EPA, New Mexico Farm & Livestock Bureau Sign Pact to Expand Support for Sustainable Farming
The U.S. Environmental Protection Agency (EPA) and the New Mexico Farm & Livestock Bureau (NMF&LB) signed a three-year Memorandum of Understanding (MOU) to expand joint activities supporting the agencies’ shared goal of well-managed, sustainable farms. The agreement is the first among states in EPA Region 6, which also includes Arkansas, Louisiana, Oklahoma and Texas.

The U.S. Environmental Protection Agency (EPA) is accepting applications for a $1 million dollar grant initiative through the Pesticide Environmental Stewardship Program (PESP) that encourages smart, sensible, and sustainable pest control in agriculture. EPA is accepting public comments on nominations for membership on the Federal Insecticide, Fungicide, and Rodenticide Act Scientific Advisory Panel (FIFRA SAP). The agency anticipates selecting new members to serve on the panel to replace members whose terms will soon expire. The U.S. Environmental Protection Agency (EPA) announced Bear River Supply Inc., based in Rio Oso, Calif., has agreed to pay a $50,578 penalty to resolve EPA’s findings that the company produced pesticides in an unregistered establishment, distributed and sold misbranded pesticides and failed to maintain equipment properly. Ensuring agricultural pesticide products are properly produced, labeled and distributed protects workers, the public, and the environment. The company has since corrected the violations. The Environmental Protection Agency (EPA) has submitted an information collection request (ICR), Tolerance Petitions for Pesticides on Food or Feed Crops and New Food Use Inert Ingredients (EPA ICR Number 0597.13, OMB Control Number 2070– 0024) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act. This is a proposed extension of the ICR, which is currently approved through April 30, 2022. Public comments were previously requested via the Federal Register on August 17, 2020 during a 60-day comment period. This notice allows for an additional 30 days for public comments. The Environmental Protection Agency (EPA) has submitted an information collection request (ICR), Notice of Supplemental Distribution of a Registered Pesticide Product (EPA ICR Number 0278.13, OMB Control Number 2070–0044) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act. This is a proposed extension of the ICR, which is currently approved through February 28, 2021. EPA previously provided a 60- day public review opportunity via the Federal Register on August 17, 2020. With this submission, EPA is providing an additional 30-days for public review. A fuller description of the ICR is given below, including its estimated burden and cost to the public. An Agency may not conduct or sponsor and a person is not required to respond to a collection of information unless it displays a currently valid OMB control number. In accordance with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA is issuing a notice of receipt of requests by registrants to voluntarily cancel certain pesticide registrations. EPA intends to grant these requests at the close of the comment period for this announcement unless the Agency receives substantive comments within the comment period that would merit its further review of the requests, or unless the registrants withdraw its requests. If these requests are granted, any sale, distribution, or use of products listed in this notice will be permitted after the registration has been cancelled only if such sale, distribution, or use is consistent with the terms as described in the final order. This regulation establishes an exemption from the requirement of a tolerance for residues of sodium lauroyl sarcosinate when used as an inert ingredient in antimicrobial pesticide formulations applied to food-contact surfaces in public eating places, dairyprocessing equipment, and foodprocessing equipment and utensils at an end-use concentration not to exceed 10,000 parts per million (ppm). Clorox Services Company representing Clorox Professional Products Company submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of sodium lauroyl sarcosinate when used in accordance with this exemption. This regulation establishes tolerances for residues of trifludimoxazin in or on multiple commodities which are identified and discussed later in this document. BASF corporation requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). This regulation establishes an exemption from the requirement of a tolerance for residues of C10–23 alkyl group-containing alkali-soluble acrylic emulsion polymer; minimum number average molecular weight 29,000 Daltons when used as an inert ingredient in a pesticide chemical formulation. Ag-Chem Consulting LLC on behalf of Corbet Scientific LLC submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of C10–23 alkyl groupcontaining alkali-soluble acrylic emulsion polymer on food or feed commodities. This notice provides the names, addresses, and professional affiliations of persons recently nominated to serve on the Scientific Advisory Panel (SAP) established under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The Panel was created on November 28, 1975, and made a permanent Panel by amendment to FIFRA, dated October 25, 1988. This notice announces the availability of EPA’s Sulfuryl Fluoride Draft Interim Re-Entry Mitigation Measures and several registration review draft risk assessments for sulfuryl fluoride. Registration review is EPA’s periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, that the pesticide can perform its intended function without causing unreasonable adverse effects on human health or the environment. Through this program, EPA is ensuring that each pesticide’s registration is based on current scientific and other knowledge, including its effects on human health and the environment. EPA may pursue mitigation at any time during the registration review process if it finds that a pesticide poses unreasonable adverse effects to human health or the environment. To address human health incidents and in response to EPA’s Office of Inspector General 2016 (OIG) Report, Additional Measures Can Be Taken to Prevent Deaths and Serious Injuries From Residential Fumigations (No. 17–P–0053), the EPA believes that the mitigation measures outlined in this Sulfuryl Fluoride Draft Interim Re-Entry Mitigation Measures are necessary to address identified human health risk concerns. The scope of this interim mitigation is focused on the use of sulfuryl fluoride as a structural fumigant in residential use sites. EPA has received specific exemption requests from the Pennsylvania Department of Agriculture and the Virginia Department of Agriculture and Consumer Services to use the pesticide dinotefuran (CAS No. 165252–70–0) to treat up to 25,000 and 29,000 acres, respectively, of pome and stone fruits to control the brown marmorated stinkbug. The applicants propose uses which are supported by the Interregional Research Project Number 4 (IR4) program and have been requested in 5 or more previous years, and petitions for tolerances have not yet been submitted to the Agency. Therefore, as required, EPA is soliciting public comment before making the decision whether or not to grant the exemptions. EPA Publishes 28th Annual U.S. Greenhouse Gas Inventory
The U.S. Environmental Protection Agency (EPA) released its 28th annual Inventory of U.S. Greenhouse Gas Emissions and Sinks (GHG Inventory), which presents a national-level overview of annual greenhouse gas emissions from 1990 to 2019. Net U.S. greenhouse gas emissions were 5,769 million metric tons of carbon dioxide equivalent in 2019, a 1.7 percent decrease in emissions between 2018 and 2019. While many long-term and short-term factors influence annual greenhouse gas emissions in recent years, the downward GHG emissions trend can be largely attributed to falling emissions in the electric power sector.

- EPA Reaches Settlement with Hu-Friedy of Chicago to Stop Sale of Pesticide Products
U.S. Environmental Protection Agency announced today a settlement with Hu-Friedy Mfg. Co., LLC, of Chicago, Illinois, to stop selling and distributing unregistered and misbranded pesticide products. The settlement includes a civil penalty of $464,737.50 to resolve alleged violations of the Federal Insecticide, Fungicide, and Rodenticide Act. (April 1) - U.S. EPA orders Nevada and California companies to stop selling illegal disinfectants
The U.S. Environmental Protection Agency (EPA) has ordered Macoma, LLC and FN Nano, Inc., located in Las Vegas and Reno, Nevada, as well as JT Construction Group, Inc. and BZ Nano, located in Glendale, California, to stop selling the unregistered disinfectant FN Nano Photocatalytic coatings, aka FN Coatings, FN NANO2 Photocatalytic Film. This product is an unregistered disinfectant pesticide being sold in violation of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Such practices are particularly problematic during the COVID-19 pandemic, and EPA will continue to take enforcement actions such as this ‘Stop Sale’ order to protect public health. (April 1) - Product Cancellation Order for Certain Pesticide Registrations
This notice announces EPA’s order for the cancellations, voluntarily requested by the registrants and accepted by the Agency, of the products listed in Table 1 of Unit II, pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This cancellation order follows a July 30, 2020 Federal Register Notice of Receipt of Requests from the registrants listed in Table 2 of Unit II to voluntarily cancel these product registrations. In the July 30, 2020 notice, EPA indicated that it would issue an order implementing the cancellations, unless the Agency received substantive comments within the 180-day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests. The Agency received two anonymous public comments on the notice, but none merited its further review of the requests. Further, the registrants did not withdraw their requests. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested cancellations. Any distribution, sale, or use of the products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions. Inc., on behalf of Solvay USA, submitted a petition to EPA under section 346a of the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 2,2-dimethyl-1,3- dioxolane-4-methanol, when used in accordance with these exemptions. The Environmental Protection Agency (EPA) is soliciting public comments and suggestions about the petition process for exemptions regarding pesticides from registration and other requirements under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), where the pesticides are determined to be of a character unnecessary to be subject to regulation under FIFRA. The Agency is considering streamlining the petition process and revisions to how the Agency evaluates the potential minimum risk active and inert substances, factors used in classes of exemptions, state implementation of the minimum risk program and the need for any future exemptions or modifications to current exemptions. EPA is also requesting comment on whether the Agency should consider amending existing exemptions or adding new classes of pesticidal substances for exemption, such as peat when used in septic filtration systems. The Biden-Harris Administration is committed to ensuring agricultural workers and pesticide handlers are provided with access to information and health protections similar to those already afforded to workers in other industries. EPA provides resources and conducts initiatives to protect the well-being of farmworkers and their communities.

Four-Week Webinar Kicks Off Addressing Economy and Food Insecurity
The Delaware Valley Regional Planning Commission (DVRPC), along with the U.S. Economic Development Administration (EDA) and U.S. Environmental Protection Agency (EPA) kicked off a four-week webinar summit series today looking at increasing and economically supporting local agriculture throughout the Mid-Atlantic Region. The program brings together stakeholders from the business sector, food industry, local improvement districts and governmental agencies. The events will take place every Wednesday from March 17 – April 7.

Michael S. Regan was sworn in as the 16th Administrator of the U.S. Environmental Protection Agency (EPA) today. On his first day, Administrator Regan committed to working closely with and supporting EPA's dedicated career public servants, restoring the role of science and transparency, addressing climate change, and prioritizing environmental justice. Administrator Regan is the first Black man and the second person of color to lead the U.S. EPA.

EPA announces grant funding to Focus Points Family Resource Center to develop an urban agriculture training program in Northeast Denver
The U.S. Environmental Protection Agency (EPA) announced the agency will award Focus Points Family Resource Center of Northeast Denver $70,000 in grant funding to develop their Huerta Urbana urban agriculture project. The funding, awarded through the Agency’s Office of Environmental Justice grants program, will be used to provide community members training and hands-on experience to grow, harvest and distribute food locally.

EPA Releases Testing Data Showing PFAS Contamination from Fluorinated Containers
As the U.S. Environmental Protection Agency (EPA) pursues its mission to protect human health and the environment, addressing risks related to PFAS is a priority. To this end, EPA is making available new testing data related to PFAS found in fluorinated containers in which a mosquito control product was packaged and sold. EPA is also announcing its planned next steps to further characterize and address this potential source of contamination.

Pesticide Product Performance Data Requirements for Products Claiming Efficacy Against Certain Invertebrate Pests
The Environmental Protection Agency (EPA) is proposing to codify product performance data requirements to support registration of pesticidal products claiming efficacy against three categories of invertebrate pests: Those identified to be of significant public health importance (e.g., ticks, mosquitoes, cockroaches, etc.), wooddestroying insects (e.g., termites), and certain invasive invertebrate species (e.g., Asian longhorned beetle). The latter two categories are pests considered to be of significant economic or ecological importance. Product performance data (efficacy studies) document how well the pesticide performs the intended function, such as killing or repelling, against an invertebrate pest. (March 22) -

After Careful Consideration, EPA Supports Tenth Circuit’s Renewable Fuels Association Decision
EPA is today announcing that, after careful consideration of the 2020 decision of the U.S. Court of Appeals for the Tenth Circuit in Renewable Fuels Association et al. v. EPA, 948 F.3d 1206 (“Decision”), EPA supports that court’s interpretation of the renewable fuel standard (RFS) small-refinery provisions. This conclusion, prompted by a detailed review following the Supreme Court’s grant of certiorari in the case, represents a change from EPA’s position before the Tenth Circuit. The change reflects the Agency’s considered assessment that the Tenth Circuit’s reasoning better reflects the statutory text and structure, as well as Congress’s intent in establishing the RFS program.

EPA Takes RFS-related Actions to help Farmers and Refiners
The U.S. Environmental Protection Agency (EPA) is taking a number of actions through the Renewable Fuel Standard program to provide certainty to impacted stakeholders. These actions include proposing to modify underground storage tank (UST) regulations to accommodate the safe storage of E15 and higher ethanol blends at retail stations’ existing tank systems, proposing to extend the compliance time for certain obligated parties subject to the 2019 Renewable Volume Obligation (RVO) and all obligated parties subject to the 2020 RVO given ongoing economic disruptions as a result of the COVID-19 pandemic, and more.
E15 Fuel Dispenser Labeling and Compatibility With Underground Storage Tanks
EPA currently requires fuel dispenser labels for gasoline-ethanol blends of greater than 10 volume percent (vol%) ethanol and up to 15 vol% ethanol (E15). The label was designed to alert consumers to the appropriate and lawful use of the fuel. EPA is co-proposing to either modify the E15 label or remove the label requirement entirely and seeking comment on whether state and local governments may be preempted from requiring different labels on fuel dispensers. To facilitate the proper storage of E15 in underground storage tank systems (USTs), EPA is proposing to modify the UST regulations to grant certain allowances for compatibility demonstration for storage of ethanol blends. EPA is also proposing compatibility requirements for future UST installations or component replacements that would ensure compatibility with higher blends of ethanol.

EPA Announces $46 Million in Funding Available to Reduce Emissions from Diesel Engines
The U.S. Environmental Protection Agency (EPA) announced the availability of grant funding to implement projects which reduce emissions from the nation’s existing fleet of older diesel engines. EPA anticipates awarding approximately $46 million in Diesel Emissions Reduction Act (DERA) grant funding to eligible applicants, subject to the availability of funds. Under this competition, EPA anticipates awarding between 40 and 70 assistance agreements.
EPA Releases 2020 Report on Supporting Rural America
The U.S. Environmental Protection Agency (EPA) released its 2020 Support of Rural America Report which highlights key scientific decisions and successful partnerships that directly impact rural communities across the country, and ultimately, our nation's food supply. Administrator Wheeler Wraps Up Visit to Mississippi, Highlights Agriculture Partnership
U.S. Environmental Protection Agency (EPA) Administrator Andrew Wheeler wrapped up his visit to Mississippi announcing a multi-million-dollar grant initiative dedicated to sustainable pest control in agriculture. While in Mississippi, he also held meetings with elected officials, hosted a press conference on the Yazoo Backwater Area Pumps Project, and signed a Memorandum of Understanding (MOU) with the Mississippi Farm Bureau.
In Mississippi, Administrator Wheeler Announces Multi-Million-Dollar Initiative Dedicated to Sustainable Pest Control in Agriculture
At an event with the Mississippi Farm Bureau, U.S. Environmental Protection Agency (EPA) Administrator Andrew Wheeler announced a $2 million dollar initiative that encourages smart, sensible, and sustainable pest control in agriculture. Administrator Wheeler was also joined by U.S. Senator Cindy Hyde-Smith, Mississippi Department of Environmental Quality Director Chris Wells, Mississippi Department of Agriculture and Commerce Commissioner Andy Gipson, Mississippi State Senator Charles Younger, Mississippi Farm Bureau President Mike McCormick, EPA Regional Administrator Mary Walker, and EPA Chief of Staff Mandy Gunasekara for the announcement. The initiative, which is an extension of EPA’s Pesticide Environmental Stewardship Program (PESP), expects to award grantees up to $200,000 to implement sustainable pest management practices that align with the agency’s goal of providing a healthier environment for all Americans.
U.S. EPA settles with California’s Helena Agri-Enterprises for violating federal law
The U.S. Environmental Protection Agency (EPA) announced a settlement with Helena Agri-Enterprises, LLC for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) at its establishments in Exeter, Oxnard, Modesto, and Kerman, California. The company has agreed to pay a civil penalty of $88,000 and has certified they are now in compliance.

Arkansas: Final Approval of State Underground Storage Tank Program Revisions and Incorporation by Reference
Pursuant to the Resource Conservation and Recovery Act (RCRA or Act), the Environmental Protection Agency (EPA) is taking direct final action to approve revisions to the State of Arkansas’s Underground Storage Tank (UST) program submitted by the State. EPA has determined that these revisions satisfy all requirements needed for program approval. This action also codifies EPA’s approval of Arkansas’s State program and incorporates by reference those provisions of the State regulations that we have determined meet the requirements for approval. The provisions will be subject to EPA’s inspection and enforcement authorities under Subtitle I of RCRA sections 9005 and 9006 and other applicable statutory and regulatory provisions. DATES: This rule is effective March 8, 2021, unless EPA receives adverse comment by February 8, 2021. If EPA receives adverse comment, it will publish a timely withdrawal in the Federal Register informing the public that the rule will not take effect. The incorporation by reference of a certain publication listed in the regulations is approved by the Director of the Federal Register, as of March 8, 2021, in accordance with 5 U.S.C. 552(a) and 1 CFR part 51.

All ten Environmental Protection Agency (EPA) Regions are proposing for public comment the draft 2021 National Pollutant Discharge Elimination System (NPDES) pesticide general permit (PGP)—the draft 2021 PGP. The draft 2021 PGP covers point source discharges from the application of pesticides to waters of the United States. Once finalized, the draft 2021 PGP will replace the existing permit, the 2016 PGP, which was issued for a fiveyear term in the Federal Register on October 31, 2016, and expires October 31, 2021, at midnight. The draft 2021 PGP has the same conditions and requirements as the 2016 PGP and would authorize certain point source discharges from the application of pesticides to waters of the United States in accordance with the terms and conditions described therein. EPA proposes to issue this permit for five (5) years in all areas of the country where EPA is the NPDES permitting authority. EPA solicits public comment on all aspects of the draft 2021 PGP. This Federal Register document describes the draft 2021 PGP in general and seeks comment as described in Section III.C, of this document.
