Tuba City Dump Administrative Order on Consent
Pursuant to the Resource, Conservation and Recovery Act (“RCRA The Resource Conservation and Recovery Act (RCRA) protects human health and the environment from the potential hazards of waste disposal, conserves energy and natural resources, reduces the amount of waste generated, and ensures that wastes are managed in an environmentally sound manner.”), 42 U.S.C. §§ 6901 to 6992k, United States Bureau of Indian Affairs (BIA) is to address the potential impacts to human health and environment posed by the Tuba City Dump (TCD). BIA will bring the TCD into compliance with the requirements of the Resource, Conservation and Recovery Act (“RCRA”), 42 U.S.C. §§ 6901 to 6992k by the removal of the waste, closure/post-closure and long-term groundwater monitoring in accordance with 40 CFR Part 258, ensuring that the work ordered herein be designed and implemented to protect human health and/or the environment.

Alleged Violations: EPA alleges that BIA was not in compliance with RCRA regulations, including the requirement to properly close the open municipal solid waste dump it had operated on land it held in trust for the Tribes.
