About Controlled Unclassified Information (CUI) at EPA

Controlled Unclassified Information (CUI) is sensitive but unclassified information that requires safeguarding and dissemination controls pursuant to law, regulation, or Government-wide policy.

Program

The U.S. Environmental Protection Agency’s (EPA) Controlled Unclassified Information (CUI) Program establishes the policy, procedures, training, guidance, and framework for safeguarding and sharing the Agency’s CUI, in compliance with CUI implementing regulation (32 CFR Part 2002). 

The EPA annually submits a report on the state of its CUI Program to the National Archives and Records Administration (NARA), ensuring the EPA is meeting all federally mandated CUI Program implementation deadlines and Government-wide standards. EPA’s CUI Program is staffed within the Enterprise Records Management and CUI Division (ERMC) of the Office of Records, Administrative Systems, and eDiscovery (ORASE), located in the Office of Mission Support (OMS). The U.S. Environmental Protection Agency (EPA) published its CUI Policy and CUI Procedure in February 2023

Waivers

Legacy Marking Waiver

Documents created prior to February 15, 2023, the start date for EPA’s implementation of new CUI markings, are considered legacy information and are not required to be reviewed and re-marked unless they contain information that qualifies as CUI AND the information is reused OR expected to be transmitted outside of EPA.

Limited Marking Waiver

Documents created after February 15, 2023, the start date for EPA’s implementation of new CUI markings, are required to be marked as CUI in accordance with EPA’s CUI Policy and Procedure. Under this waiver, CUI categories not included in the CUI Marking Tool are exempt from this marking requirement. The CUI Marking Tool will be updated in phases, with 8-10 categories of CUI included each year.
