- May 12, 2025 – EPA issues final rule removing WEC regulation from Code of Federal Regulations (pdf) (258 KB)
- March 14, 2025 – President Trump signs joint Congressional resolution disapproving final WEC rule
The WEC final rule was disapproved by a joint resolution of Congress pursuant to the Congressional Review Act. President Trump signed the Joint Resolution of Disapproval under the Congressional Review Act on March 14, 2025. This regulation no longer has any force of law and is not in effect, and facilities will not be required to submit their WEC filings by September 2, 2025. EPA is currently evaluating options and obligations for implementing Clean Air Act section 136(c-g) and will provide additional information to the regulated community at an appropriate time.
On May 12, 2025, in line with the joint Congressional resolution disapproving the final WEC rule, EPA issued a final rule to remove the WEC regulations from the Code of Federal Regulations (CFR). This administrative action ensures the current requirements applicable to subpart W reporters are accurately reflected in the CFR.
The 2024 Final Waste Emissions Charge Rule and supporting materials are provided below for informational purposes only. This rule is no longer in effect as a result of a joint Congressional resolution (see note above).
