Updates global warming potentials (GWPs), expands the GHGRP to new source categories, and revises the requirements for certain sectors to improve the data collected and program implementation.

Revises 29 subparts to streamline implementation, improve data quality, provide flexibility, and clarify the rule. Establishes confidentiality determinations for new or substantially revised data elements. Final action in response to a Petition for Reconsideration.

11/30/2016 81 FR 86490 Final Rule Revises subpart W (Petroleum and Natural Gas Systems) to add new monitoring methods consistent with the New Source Performance Standard for the oil and gas industry. Also finalizes emission factors for leaking equipment, and establishes confidentiality determinations for new or substantially revised data elements.

Waste Emissions Charge (WEC)

On March 14, 2025, a joint Congressional resolution disapproved the 2024 Final Waste Emissions Charge Rule. This regulation no longer has any force of law and is not in effect, and facilities will not be required to submit their WEC filings by September 2, 2025. EPA is currently evaluating options and obligations for implementing Clean Air Act section 136(c-g) and will provide additional information to the regulated community at an appropriate time.
